Ex-ante regulation of the fixed origination market ended


On 4 October 2018, ANACOM approved the final decision on the wholesale market for call origination on the public telephone network provided at a fixed location for the provision of retail telephone services - definition of product market and geographic market, assessment of significant market power (SMP) and imposition, maintenance, amendment or withdrawal of regulatory obligations.

This decision follows from the analysis in which it was concluded that the market for call origination on the public telephone network provided at a fixed location for the provision of retail telephone services does not fulfil the three criteria set out in the European Commission Recommendation on Relevant Marketshttps://www.anacom.pt/render.jsp?contentId=984081 as would make this market susceptible to ex-ante regulation.

Consequently, there are also no operators in this wholesale market designated as enjoying SMP. Accordingly, the obligations imposed on MEO - Serviços de Comunicações e Multimédia in this market cease to apply, except as regards the price control obligation, which is maintained in its current form (i.e. maintaining the same prices and with applicability to the services of call origination for provision of retail telephone services and to Wholesale Line Rental Offer (WLRO) accesses existing as on the date of this decision). This obligation may not be withdrawn until 18 months following the decision on this market, which necessarily implies that the WLRO itself will also have to remain in force for current accesses during the period in question.

It is recalled that the respective draft decisionhttps://www.anacom.pt/render.jsp?contentId=1458585 was notified to the European Commission (EC), the Body of European Regulators for Electronic Communications (BEREC) and the national regulatory authorities of the other Member States of the European Union. The Commission responded on 10 September.
