ANACOM submits 2019-2021 activities plan for public consultation


ANACOM - Autoridade Nacional de Comunicações (communications regulator) is today putting the strategic objectives and main actions for its 2019-2021 activities plan out for public consultation. With this practice of submitting the preparation of its activity plan to public participation, ANACOM gives all interested parties the opportunity to express their views on their activity for the next three years, with a particular focus on the activity to be pursued as soon as 2019.

Everyone can participate in this consultation procedure, from consumers to operators, through associations, municipalities, universities and other relevant entities. For ANACOM, being open to the opinion and contribution of all stakeholders is desirable and it is essential to better establish the priorities for the future, to increase the transparency of this Authority and to meet the needs felt by all those who contribute to developing the communications sector in Portugal.

In accordance with the document now under consultation, and taking into account the responsibilities arising from the statutes of ANACOM, national legislation and the European Union, this Authority proposes to develop its 2019-2021 multi-annual activity plan based on the three following strategic objectives:

  • To help to ensure that the whole country benefits to the full in terms of choice, price, quality and security of postal and electronic communications services, through an active and demanding regulation that promotes efficient investment, facilitates infrastructure sharing and ensures loyal and dynamic competition.
  • To ensure maximum protection of the rights of communications users throughout the territory and, with particular reference to the most vulnerable members of society, by promoting a regulatory framework that gives priority to information and transparency and which discourages and punishes bad practices.
  • To strengthen and empower regulation in Portugal by fully respecting its autonomy, impartiality and independence, and by demanding strict fulfilment of its mission, in particular by sharing information and knowledge and fostering the efficiency and economy of means and resources essential for it to wholly meet its responsibilities.

These objectives aim to reinforce the effectiveness of ANACOM's mission, essential for the sustained development of the communications sector such that it meets the needs of all users and upholds the rights of citizens through specific measures always underpinned by the purpose of encouraging competition, efficient investment, quality of networks, and new generation services.

The Annex specifies the 25 actions planned and to be focused on in the first year of the 2019-2021 triennium, which ANACOM intends to develop in light of the strategic objectives identified above. All interested parties are invited to comment within the framework of this public consultation.

The public consultation will last for 20 working days, until 17 December.

To prepare contributions for the revision of the Electronic Communications Law, particularly in the light of ANACOM recommendations submitted to the Government in 2018 regarding the electronic communications US and taking into account the new Electronic Communications Code

To analyse the broadband and high-quality access markets (3a/3b and 4)

To update the regulatory framework and information sharing systems applicable to telecommunications infrastructure, in particular as regards urban/housing developments

To prepare and submit to the Government the draft legislation for transposing the revision of the European regulatory framework for electronic communications

To analyse the prices of the RCAO (reference conduit access offer), the RPAO (reference poles access offer), MAM (Mainland-Azores-Madeira) circuits and inter-islands circuits, and DTT

To analyse the impact of implementing national roaming solutions

To approve the Regulation on the pricing methodology for access and use of suitable infrastructure established in Decree-Law no. 123/2009

To collaborate in the construction of a national strategy for the interconnection submarine cables in Portugal, which will enhance their use for developing communications and for other purposes, such as seismic measurement, environmental protection and scientific research

To implement the Regulation on the security and integrity of electronic communications networks and services

To promote the implementation of measures for the protection and resilience of electronic communications infrastructure, especially in situations of extreme events or disasters

To contribute, in collaboration with the National Civil Protection Authority (ANPC), to establishing emergency policies for the networks

To pursue the actions required for the introduction of 5G in Portugal, in particular those related to the allocation of the 700 MHz band (and other relevant bands)

To draft the relevant numbering standards, including the revision of the conditions of use of geographical (and mobile) numbers in nomadism, the rules for the use of CLI (Calling Line Identification) and the creation of a specific range in the NNP for M2M (Machine to Machine) services

To develop new indicators and integrated approaches to data relevant to the market and regulation, such as various price indices relating to electronic communications services

To reformulate and rationalize the system for reporting and producing statistics in the communications sector, including helping to improve the tourism statistics system using mobile communications information

To evaluate cross-border postal parcel tariffs under the EU Regulation

To implement and monitor the solution to be adopted to encourage out-of-court dispute resolution in the communications sectors

18

To complete the regulation of procedures to be followed in handling complaints

19

To analyse the motivations behind the availability of zero-rating and specialized services and draw up the annual report provided for in the TSM Regulation (Telecoms Single Market)

20

To check compliance with coverage obligations and disseminate quality of service (QoS) data on mobile networks

21

To plan and implement actions to guarantee public access to free TV after 2020

22

To improve the quality of interaction and communication with society by publicizing the mission of ANACOM and its achievements more widely

23

To modernize the spectrum monitoring and control centres

24

To develop cooperation projects with municipalities and outreach actions with local populations that encourage the development of digital literacy and the communications sector throughout the national territory

To develop partnerships with the national scientific and technological system organizations
