Under the terms of and for the purposes of paragraph 1 of article 98 of Código do Procedimento Administrativo (Administrative Proceeding Code) and of paragraph 1 of article 10 of the Statutes of Autoridade Nacional de Comunicações (ANACOM), it is announced that the Board of Directors of ANACOM, pursuant to the powers and responsibilities set out in point u) of paragraph 1 of article 8, and as under point a) of paragraph 2 of article 9 and of point b) of paragraph 1 of article 26 of its Statutes (as approved by Decree-Law no. 39/2015https://www.anacom.pt/render.jsp?contentId=1351851 of 16 March), pursuant to the powers and responsibilities set out in point e) of paragraph 1 of article 22 and article 30 of Decree-Law no. 16/2019https://www.anacom.pt/render.jsp?contentId=1466788 of 22 January, decided, on 4 April 2019, to commence the regulatory procedure as regards the space activities referred to in articles 5, 7, 16 and 17, specifically:
a) Procedure governing the granting of prior qualification certificates in the exercise of space activities.
b) Requirements of the systems and processes to be implemented by the launch centre operator.
c) Procedure for granting licences and criteria for assessing the conditions for granting licences;
d) Items to be registered with the Space Authority;
e) Transfer of ownership of space objects.
Accordingly, interested parties may, within ten working days of the present announcement, submit such written contributions and suggestions as they deem should be considered in the preparation of this regulatory procedure, sending them to ANACOM at reg.espaco@anacom.ptmailto:reg.espaco@anacom.pt.
At a later date, interested parties will have opportunity to express their views on the draft regulation which will be submitted to public consultation in accordance with Article 10 of ANACOM's Statutes, following publication on ANACOM's institutional website (www.anacom.pthttps://www.anacom.pt/render.jsp?categoryId=2958) and in 2nd Series of Diário da República (Official Journal).
ANACOM will examine the contributions and suggestions advanced by interested parties, and upon approval of the regulation, will produce a report making reference to all replies received and providing an overall assessment that reflects ANACOM's position thereon and its reasoning for the options taken.
