FCSU - setting of the value of the contributions related to the net costs of the universal electronic communications service for 2018


On 17 January 2020, ANACOM approved the decision regarding the identification of entities obliged to contribute to the universal service compensation fund (FCSU) for electronic communications and the setting of the value of contributions referring to the net costs of the universal service (CLSU) to be offset for 2018.

Considering the provisions of the LCE - Lei da Comunicações Eletrónicas (Electronic Communications Lawhttps://www.anacom.pt/render.jsp?categoryId=333114) and Lei do Fundo (Law Governing the Fundhttps://www.anacom.pt/render.jsp?contentId=1136652), the following' is specifically determined by this Authority:

  • The revision of the values of eligible turnover of some companies for the purpose of calculating the overall eligible turnover of the sector, namely following an audit and analysis carried out by ANACOM.
  • The value of the sector's overall eligible turnover (VNE) for 2018 is 4,158,573,900.99 euros, for the purposes of the FCSU Law.
  • The list of entities that must pay the contributions for the CLSU of the providers of the universal service (US) designated by tender.
  • The amount of the contribution of each entity for the following purposes:

- compensation of the CLSU for 2018, the provision of which was provided by NOS Comunicações, under the contracts signed with the Portuguese State for the provision of the US for connection to a public communications network at a fixed location and publicly available telephone services;

- compensation of the CLSU for 2018, the provision of which was provided by MEO - Serviços de Comunicações e Multimédia (MEO), under the contract entered into with the Portuguese State for the provision of the US of public pay phones;

- compensation of the CLSU for 2018, the provision of which was provided by MEO under the contract entered into with the Portuguese State for the provision of the US with a complete telephone directory and a complete directory inquiry service.

It was also decided to authorise MEO not to transfer the amount of the contribution referring to the CLSU for 2018, a payment it is under obligation to make, given that the amount of compensation to which it is entitled, as provider of the US for the provision of public payphones and provision of a complete telephone directory and a complete directory inquiry service, is greater than the amount of the contribution it is required to pay. Thus, the amount of compensation to which the company is entitled for the provision of the US for the provision of public pay phones and the provision of a complete telephone directory and a complete directory inquiry service is deducted from the value of its overall contribution relating to CLSU for 2018.
