Universal service compensation fund - setting of the value of the contributions relative to the net costs of the universal service of electronic communications for 2019


On 28 January 2021, ANACOM approved the decision on the identification of the entities obliged to contribute to the universal service compensation fund (FCSU) of electronic communications and the setting of the value of the contributions to the net costs of the universal service (CLSU) for compensation relative to 2019.

Considering the provisions in the Electronic Communications Lawhttps://www.anacom.pt/render.jsp?contentId=975162 (LCE) and in the Fund Lawhttps://www.anacom.pt/render.jsp?contentId=1136652, ANACOM determines:

  • The review of the eligible turnover amounts of some companies for the purposes of calculating the total eligible turnover for the sector, namely further to the audit or verification carried out by ANACOM.
  • The total eligible turnover amount for the sector (4 158 369 882.39 euros) pertaining to 2019.
  • The list of entities that should pay the contributions to the net costs of the universal service of the universal service provider appointed by tender.
  • Approve the value of the contribution of each entity for the following purposes:

- compensation of the net costs of the universal service pertaining to 2019, whose provision was ensured by NOS Comunicações, under the contracts signed with the Portuguese State as a universal service provider for connection to a public communications network at a fixed location and publicly available telephone services;

- compensation of the net costs of the universal service pertaining to 2019, whose provision was ensured by MEO - Serviços de Comunicações e Multimédia (MEO), under the terms of the contract signed with the Portuguese State as a universal service provider of public pay-telephones.

ANACOM also decided to authorise MEO to not proceed with the transfer of the value of the contribution to the net costs of the universal service pertaining to 2019, being bound to this payment, as the value of the compensation to which it is entitled as a universal service provider value of public pay-telephones is higher than the value of the contribution which it is bound to pay. Thus, the amount of compensation to which the company is entitled as a universal service provider of public pay-telephones is net of the value of its overall contribution to the net costs of the universal service for 2019.
