ANACOM initiates 113 cases with offence proceedings in the first quarter of 2021


Between January and March 2021, ANACOM initiated offence proceedings in 113 cases, an increase of 74% from the same period of 2020.

Meanwhile, 104 new cases were opened as a result of reported breaches, compared to 109 new cases in the same period of 2020.

In the 1st quarter of 2021, ANACOM concluded 64 cases with offence proceedings, compared to 79 in the same period of 2020. From this total, 35 cases (55%) were concluded with the application of fines, totalling 439 thousand euros.

In addition to the 35 cases in which fines were applied, 17 cases were concluded with the application of accessory sanctions or admonitions. In the remaining 12 cases, 9 were merged with other cases, one was immediately filed, another was concluded with the acquittal of the accused and another was referred to the authority with competence to address the matters involved.

The breaches sanctioned by ANACOM in the period from January to March 2021 relate to non-compliance with obligations applicable to the installation of telecommunications infrastructures in buildings; non-compliance with respect to radio equipment, the use of radiocommunications networks and services, contractual complaints and contract modifications. There were also situations of non-compliance with Complaint Book legislation and with obligations to report information to ANACOM.
