  • ANACOM launches consultation on the criterion to be adopted to assess compliance with performance targets associated to quality indicators of the universal postal service, calculated through samples.
  • ANACOM launches consultation on MEO’s proposal to remedy the lack of coverage of the land-based DTT service, in the town of Baião, São Marcos da Serra, municipality of Silves.
  • 5G Auction - ANACOM approves the issue of the title of rights of use for frequencies allocated to MEO, which is now entitled to launch the commercial operation of 5G.
  • ANACOM launches consultation on the review of the prices of circuits connecting Mainland Portugal and the Autonomous Regions of Azores and Madeira (MAM circuits) and the prices of circuits connecting several islands of the Azores (inter-island circuits), provided by MEO  under the Leased Lines Reference Offer (LLRO) and the Reference Ethernet Leased Lines Offer (RELLO).
  • ANACOM launches the guide “Ligar ao Condomínio” (Connect to the Condominium), which gathers a set of guidelines and good practices aimed at facilitating the management of telecommunication infrastructures in the common parts of older buildings.
  • ANACOM launches public consultation on the use of the 26 GHz band for the development of 5G.
  • EC announces agreement reached between European Parliament and EU Member States on new Roaming Regulation, which will enter into force on 1 July 2022, and will adjust and create new rules in the Roaming Regulation.
  • Publication, on 7 December, of Decree-Law No 108/2021, which amends the competition regime, the regime of individual trade restrictive practices and the regime of general contractual clauses.
  • ANACOM approves the Regulation on the sub-allocation of E.164 numbers of the National Numbering Plan, which allows numbers allocated by ANACOM to providers of electronic communications networks and services to be sub-allocated to other companies (by means of a contract), enabling the latter, when offering electronic communications services, to use those numbers by allocating them to end users of their own retail offers (Regulation No 1028/2021, of 29 December).
  • Publication, on 6 December, of Decree-Law No 107/2021, changing the regime of fees of the Regulatory Authority for the Media.

November

  • Publication, on 29 November, of Administrative Rule No 274-A/2021, which establishes the model, procedures and conditions required for implementing Decree-Law No 66/2021, of 30 July, which establishes the social tariff for Internet service provision.
  • 5G Auction - ANACOM approves the issue of titles of rights of use for frequencies allocated to NOS, DENSE AIR, VODAFONE, NOWO and DIXAROBIL, which are now entitled to launch the commercial operation of 5G.
  • WiFi4EU - 160 Portuguese municipalities have installed Wi-Fi in public places, under the scope of the WiFi4EU initiative that awarded vouchers to cover the cost of equipment and installation of the Wi-Fi system.
  • ANACOM redesigns the 5G Portal, created with the goal of enabling all potential users of 5G networks and services - citizens, businesses, academia, municipalities, among others - to access information and knowledge on 5G characteristics and potential, as well as how the deployment of this technology is evolving in Portugal.
  • 5G Auction - ANACOM approves final auction report.
  • ANACOM sets at 0.2798% the value of the t2 contribution percentage to be applied to the relevant income of postal service providers, with reference to 2021.

  • Publication, on 15 November, of Order No 11204/2021, which establishes the Evaluation Commission in charge of drafting the specifications of the future universal postal service concession contract, as well as of analysing the proposal to be submitted by CTT.
  • Publication, on 10 November, of Order No 10987/2021, which charges ANACOM with the task of collecting updated information on the coverage of very high capacity public electronic communications networks in national territory and drawing up draft tender specifications for tendering procedures to be carried out by the Government.
  • Publication, on 3 November, of Council of Ministers’ Resolution No 144/2021, which determines that the universal postal service shall be provided by a single provider throughout the entire national territory.
  • Publication, on 3 November, of the Council of Ministers' Resolution No 148/2021, which appoints Patricia Silva Gonçalves as a Member of ANACOM’s Board of Directors.
  • Decree-Law No 59/2021 of 14 July comes into force on 1 November, establishing the regime applicable to the availability and disclosure of telephone lines for consumer contact by the providers of essential public services.

October

  • ANACOM grants CTT’s request to deduct the records affected by the COVID-19 pandemic, for the purposes of calculating the quality of service indicators for 2021.
  • 5G auction - on 27 October the main bidding phase of the auction ends, after 1727 rounds, reaching a total amount of EUR 566.802 million.
  • ANACOM launches a public consultation on MEO’s cost of capital rate for 2021.
  • Publication, on 20 October, of Decree-Law No 87/2021, which establishes the rules of operation and the penalty system applicable to unmanned aircrafts.
  • Publication, on 18 October, of Decree-Law No 84/2021, which governs consumer rights in the purchase and sale of digital goods, content and services, transposing Directives (EU) 2019/770 and (EU) 2019/771.
  • Publication, on 18 October, of Commission Implementing Decision (EU) 2021/1827 on standards for postal services and the improvement of quality of service in support of Directive 97/67/EC of the European Parliament and of the Council.
  • ANACOM approves the start of the procedure to draw up the regulation on the methodology for calculating the net costs of providing the social tariff for broadband internet access services.
  • ANACOM approves the report of the public consultation on the strategic guidelines for the 2022-2024 three-year period and the multi-annual activity plan for 2022-2024, including the budget for 2022.

September

  • Publication, on 28 September, of Commission Implementing Decision (EU) 2021/1730 laying down harmonised conditions for the availability and efficient use of radio spectrum for the rail mobile radio communication system in the 874.4-880.0 MHz, 919.4-925.0 MHz and 1900-1910 MHz bands.
  • ANACOM approves set of decisions concerning the internet social tariff: proposal on the value of the social tariff for broadband Internet access services; definition of bandwidth and other quality of service parameters to be observed in the social tariff for the provision of fixed and mobile broadband internet access services; definition of conditions required for the granting, application and maintenance of the social tariff for provision of fixed or mobile broadband internet access services; and concept of unfair burden with the provision of broadband Internet access service.
  • Publication, on 16 September, of Rectification Declaration No 30/2021, which rectifies Decree-Law No 66/2021, of 30 July, which establishes the social tariff for broadband Internet access services.
  • ANACOM approves the Regulation amending Regulation No 987-A/2020 of 5 November, as amended by Regulation No 596-A/2021 of 30 June, which defines the procedures applicable to the auction and the conditions governing the rights of use for frequencies allocated in the 700 MHz, 900 MHz, 1800 MHz, 2.1 GHz, 2.6 GHz and 3.6 GHz bands (Regulation No 867-A/2021 of 20 September).
  • EC presents a draft decision establishing the 2030 “Path to the Digital Decade” Policy Programme, which sets out a plan for the digital transformation of society and the economy by 2030.
  • Publication, on 10 September, of the Council of Ministers’ Resolution No 129/2021, of  10 September, which approves the procedure for the coordination of the Public Administration Digital Transition initiatives integrated in the Recovery and Resilience Plan.
  • Publication, on 10 September, of Resolution of the Council of Ministers No 131/2021, which approves the Digital Transformation Strategy for Public Administration 2021-2026 and the respective Transversal Action Plan for the parliamentary term.
  • ANACOM approves the action arising from the audit carried out on the recast results of CTT’s cost accounting system (CAS), relating to financial year 2018 and the statement of compliance of the 2018 CAS, published through Notice No 17438/2021, of 15 September.

August

  • Publication, on 26 August, of Law No 68/2021, which approves the general principles on open data and transposes into national law Directive (EU) 2019/1024 of the European Parliament and of the Council of 20 June 2019 on open data and the re-use of public sector information, amending Law No 26/2016, of 22 August.
  • On 25 August, the standard banning font sizes smaller than 11 or 2.5 millimetres and line spacing shorter than 1.15 in consumer contracts with general contractual clauses comes into force (Law No 32/2021, of 27 May).
  • Publication, on 25 August, of Decree-Law No 74/2021, which implements the Cinema Law (Law No 55/2012) with regard to the collection of fees and the investment obligations which operators are required to comply with.
  • Publication, on 19 August, of Resolution No 34/2021/M of the Legislative Assembly of the Autonomous Region of Madeira on the Recommendation to the Government of the Republic on the public radio and television service between the State and RTP.
  • Publication, on 18 August, of Law No 58/2021, which introduces changes in the declaratory obligations regarding membership or performance of functions in bodies of an associative nature, amending Law No 52/2019, of 31 July, and the Statute of Parliament Members.
  • ANACOM launches public consultations on the proposal for the value of the social tariff for access to fixed or mobile broadband internet service; the definition of the bandwidth (speed) required for the provision of broadband internet access service; the minimum quality of service parameters to be observed; and the concept of unfair burden in the provision of broadband internet access service.
  • ANACOM approves the start of the procedure to amend Regulation No 987-A/2020 of 5 November, as amended by Regulation No 596-A/2021 of 30 June (Regulation on the Auction for the Allocation of Rights of Use for Frequencies in the 700 MHz, 900 MHz, 1800 MHz, 2.1 GHz, 2.6 GHz and 3.6 GHz bands), in order to bar the use of the lowest minimum increments bidders may choose, 1% and 3%, with the aim of accelerating the pace of the auction.
  • Publication, on 11 August, of Commission Implementing Decision (EU) 2021/1339 amending Implementing Decision (EU) 2018/2048 regarding the harmonised standard for websites and mobile applications.
  • Publication, on 11 August, of Decree-Law No 71/2021, which ensures the implementation of Regulation (EU) 2017/2394 on cooperation between national authorities responsible for the enforcement of consumer protection legislation.
  • ANACOM approves change to NFAT concerning the 6725-7025 MHz band for fixed satellite service in the Earth to space direction.

July

  • Publication, on 30 July, of Decree-Law No 67/2021, which establishes the regime and defines the governance model for the promotion of technology-based innovation through the creation of technological free zones.
  • Publication, on 30 July, of Decree Law No 66/2021, which establishes the social tariff for broadband Internet access services.
  • Publication, on 30 July, of Decree-Law No 65/2021, which governs the Legal Regime for Cyberspace Security and defines the cybersecurity certification obligations in implementation of Regulation (EU) 2019/881 of the European Parliament, of 17 April 2019.
  • ANACOM approves the calculation of the amount of costs of regulating the activity of provider of electronic communications networks and services, with regard to the fees to be paid in 2021, amounting to EUR 37 144 102.
  • ANACOM approves the 2020 report and accounts of the electronic communications universal service compensation fund.
  • ANACOM approves the calculation of the amount of the costs of regulating the activity of postal service provider, with regard to the fees to be paid in 2021, amounting to EUR 2 468 092.
  • ANACOM approves the 2020 financial year report on administrative costs and the amount of fee collection.
  • Publication, on 22 July, of Regional Legislative Decree No 24/2021/A, which introduces the first amendment to Regional Legislative Decree No 9/2019/A, of 9 May, approving the legal system for licensing space activities, for prior qualification and for the registration and transfer of space objects in the Autonomous Region of the Azores.
  • ANACOM rejects CTT’s application to initiate the procedure for a review of the universal postal service pricing criteria, as the Authority consideres that there are no grounds for doing so.
  • EC publishes working document which summarises the results of an assessment of the state aid rules for broadband infrastructure deployment: (i) the Broadband Guidelines and (ii) the corresponding provisions of the General Block Exemption Regulation.
  • ANACOM launches public consultation on the main strategic guidelines of the multiannual activity plan for the 2022-2024 three-year period.
  • ANACOM launches consultation on a draft regulation on the sub-allocation of E.164 numbers from the National Numbering Plan.

  • ERGP launches consultation on the 2022 work programme.
  • Publication, on 14 July, of Decree-Law No 59/2021, which establishes the regime applicable to the availability and disclosure of telephone lines for consumer contact.
  • Publication, on 14 July, of Regulation (EU) 2021/1232 of the European Parliament and of the Council of 14 July 2021 on a temporary derogation from certain provisions of Directive 2002/58/EC as regards the use of technologies by providers of number-independent interpersonal communications services for the processing of personal and other data, for the purpose of combating online child sexual abuse.
  • ANACOM approves the renewal until 21 April 2033 of rights of use for frequencies (RUF) in the 900 MHz and 1800 MHz bands allocated to Vodafone and MEO for terrestrial electronic communications services. The renewal of RUF involves the imposition of additional obligations to cover 100 parishes of low population density, in which these providers are required to provide a mobile broadband service with a minimum speed of 100 Mbps, covering at least 90% of the population.
  • The EU Council, chaired by Portugal, adopts the Connecting Europe Facility 2.0 programme, worth EUR 33.71 billion, to fund the development of sustainable and high-performing transport, digital and energy infrastructures. The second edition of the programme runs from 2021 to 2027.

June

  • Publication, on 30 June, of Regulation No 596-A/2021, which amends Regulation No 987-A/2020, of 5 November.
  • End of the Portuguese Presidency of the EU Council (30 June), with a very positive assessment regarding legislative initiatives in the digital and electronic communications sector.
  • ANACOM approves the Regulation amending Regulation No 987-A/2020, of 5 November, which defines the procedures applicable to the auction and the conditions governing the rights of use for frequencies allocated in the 700 MHz, 900 MHz, 1800 MHz, 2.1 GHz, 2.6 GHz and 3.6 GHz bands.
  • ANACOM approves assessment of unitary cross-border tariffs (2021), arising from article 6 of Regulation (EU) 2018/644 (Cross-Border Regulation), on cross-border parcel delivery services, and its communication to the European Commission.
  • ANACOM approves amendment to the National Frequency Allocation Table (NFAT), regarding short-range devices (SRD) covered by station licence exemption, for use by more comprehensive and innovative Internet of Things (IoT) and Machine-to-Machine (M2M) applications, applications for broadband data transmission (Wi-Fi) as well as radio frequency identification (RFID).
  • ANACOM approves the draft Regulation on the sub-allocation of E.164 numbers of the National Numbering Plan.

  • Publication, on 17 June, of Commission Implementing Decision (EU) 2021/1067, on the harmonised use of the radio spectrum in the 5945-6425 MHz frequency band for the implementation of wireless access systems, including radio local area networks (WAS/RLANs).
  • ANACOM approves the social balance sheet for the 2020 financial year.
  • ANACOM launches a consultation on the draft regulation amending the regulation on the auction of bands relevant to 5G, which creates conditions for greater speed in the 5G auction by allowing for 12 daily rounds.

May

  • ANACOM approves a set of recommendations aimed at companies providing electronic communications services and postal services, following a diagnosis of user difficulties reported through complaints which came to the attention of this Authority during the COVID-19 pandemic.
  • ANACOM approves the application form for temporary suspension of contracts for the provision of electronic communications services.
  • Publication, on 28 May, of Administrative Rule No 210-A/2021 authorising SIRESP - Gestão de Redes Digitais de Segurança e Emergência to pay the costs arising from the procurement of services to manage, operate, maintain, enhance and correctly operate the SIRESP network and its equipment.
  • Publication, on 27 May, of Law No 32/2021 establishing limitations on the drafting of contractual terms and providing for the creation of a system for monitoring and preventing unfair terms, amending Decree-Law No 446/85, of 25 October, which establishes the legal framework for general contractual terms.
  • ANACOM provides its opinion on Draft Law No 83/XIV/2nd (GOV), which approves the Electronic Communications Law and transposes Directive (EU) 2018/1972, which establishes the European Electronic Communications Code.
  • ANACOM approves the reviewed value of regulation costs of the activity of postal service provider, regarding fees to be paid in 2020, from EUR 2 531 166 to EUR 2 555 166, further to the correction of the value of the regulation costs in the component of provisions for legal proceedings associated with the postal services sector. The reviewed value of the t2 contribution percentage to be applied to the relevant income of postal service providers, with reference to 2020, from 0.2705% to 0.2732%, was also approved.
  • ANACOM approves the reviewed value of regulation costs of the activity of provider of electronic communications networks and services, regarding the fees to be paid in 2020, which will increase from EUR 33 819 903 to EUR 34 351 823, due to the correction of the value of regulation costs in the component of provisions for legal proceedings associated with the electronic communications sector. The reviewed value of the t2 contribution percentage to be applied to the relevant income of providers of electronic communications networks and services, with reference to 2020, from 0.8102% to 0.8229%, was also approved.
  • Publication, on 14 May, of Resolution of the Council of Ministers No 59/2021, which reviews and approves the guiding principles of the “National Digital Competences Initiative e.2030 - INCoDe.2030” programme.
  • ANACOM launches the draft amendment to the NFAT as regards the 6725-7025 MHz band.
  • ANACOM launches the “Rumo ao 5G” (“Towards 5G”) digital guide addressed to local authorities, operators and infrastructure owners. The guide also covers issues that cut across the deployment of electronic communications networks, regardless of the technology on which they are based.
  • ANACOM launches the RED-CEM “Pare, verifique e compre em conformidade” (“Stop, Check and Buy in Compliance”) digital guide which brings together information on legal systems governing electrical and electronic equipment (radio or electronic communications), as well as good practices that may help consumers make better choices.
  • ANACOM launches consultation on the migration of 112 (national emergency number) and 117 (national forest protection number) traffic to IP interconnection.
  • ANACOM launches consultation on the renewal of the RUFs allocated to Vodafone and MEO in the 900 MHz and 1800 MHz frequency bands for terrestrial electronic communications services.
  • Publication, on 3 May, of Resolution of the Council of Ministers No 46-A/2021, authorising Infraestruturas de Portugal to conduct the procedures leading to the implementation of five road projects, using national funding resulting from the 5G Auction funds.

April

  • ANACOM releases the 2020 Annual Report and Accounts, which includes information on human resources, tangible fixed assets, intangible assets and investment, economic and financial analysis, as well as the proposed allocation of profits and financial statements, with reference to the 2020 financial year.
  • EC adopts the EU Space Programme which will ensure the further development of the current European flagship programmes, Copernicus for Earth observation and Galileo/EGNOS for satellite navigation (Regulation (EU) 2021/696 of the European Parliament and of the Council of 28 April 2021).
  • ANACOM grants the request submitted by CTT to deduct records of mailings affected by the COVID-19 pandemic for the purposes of calculating the values of quality of service indicators (QSI) for 2020.
  • ANACOM approves the final decision on information to be provided by universal postal service provider(s) to users.
  • ANACOM approves the final decision on the distribution of postal items in premises other than the home.

  • The Government launches a public consultation on the draft decree-law regulating the legal framework for cyberspace security, approved by Law No 46/2018, of 13 August, which transposes Directive (EU) 2016/1148, of 6 July (Directive on Network and Information Security - NIS), and defining the obligations on cybersecurity certification in Portugal.
  • ANACOM approves the reviewed value of the t2 contribution percentage, as well as the additional settlement of fees due by postal service providers regarding 2019.
  • ANACOM launches the “Pare, verifique e venda em conformidade” (“Stop, Check and Sell in Compliance”) campaign, designed to raise awareness among economic operators about the legal systems applicable to radio and electronic communications equipment, as well as their placing or making available on the market and in service.

  • Wifi4EU - On 1 April 2021, the new Health and Digital Executive Agency (HaDEA) took over the digital sector of the Connecting Europe Facility (CEF) programme, including the implementation of the WiFi4EU initiative.

March

  • ANACOM approves the draft Joint Order that subjects the areas bordering the Radioelectric Centre formed by the Santa Maria geodesic station which is part of the RAEGE project (Atlantic Network of Geodynamic and Space Stations) to radioelectric easement.
  • Publication, on 31 March, of Administrative Rule No 75-A/2021, which sets out how ANACOM’s net results for the 2019 financial year are to be applied.
  • Publication, on 30 March, of Commission Recommendation (EU) 2021/554 on the form, content, time limits and level of detail to be given in notifications under the procedures set in Article 32 of Directive (EU) 2018/1972 of the European Parliament and of the Council establishing the European Electronic Communications Code.
  • ANACOM approves the universal postal service prices to be applied by CTT as of 1 April 2021.
  • EU Member States, in collaboration with the EC, agree on the Connectivity Toolbox, a set of best practices to enable and encourage operators to deploy very high capacity networks, in particular 5G, as well as to increase the take-up of 5G networks among the general population.
  • EU Council defines the Cybersecurity Strategy for the Digital Decade, which outlines the action framework for protection against cyber threats.
  • ANACOM releases the “5G will be faster, more efficient and safer” video, which highlights the fact that 5G technology is more efficient compared to previous mobile generations, since it is designed to use the power required to provide quality services, thus limiting consumers’ exposure to electromagnetic fields.
  • ANACOM approves a 10% reduction in the maximum prices of circuits between the mainland and the Autonomous Regions of the Azores and Madeira (MAM circuits), provided by MEO and maintains the maximum prices of circuits connecting several islands of the Azores (inter-island circuits), as far as the leased lines reference offer (LLRO) and the reference Ethernet leased lines offer (RELLO) are concerned.
  • ANACOM sets at 100% the targets for compliance with ID1 (execution of the plan) and ID2 (percentage of deliberations within the target timeframe) indicators for 2021.
  • ANACOM launches the electronic newsletter “Notícias ANACOM” (“ANACOM News”), published fortnightly and in Portuguese, which brings together information concerning the electronic communications and postal sector, as well as consumer rights.
  • EC presents the “Digital Compass” policy, which reflects the EU’s digital ambitions and prepares Europe’s effective digital transformation by 2030.
  • ANACOM approves the value of 7.1077% for MEO’s cost of capital rate for 2020.

February

  • EC proposes new Roaming Regulation which aims to extend rules in force, for another 10 years, and improve roaming services.
  • ANACOM warns of attempted fraud by false representatives of ANACOM and recommends that the addressees of fraud/burglary attempts immediately alert the security authorities.
  • Publication, on 18 February, of Order No 1849/2021 establishing a working group responsible for analysing the evolution of the universal postal service.
  • Publication, on 17 February, of Resolution of the Council of Ministers No 10-B/2021 that reallocates until the end of the 2020-2021 school year the capacity reservation in Multiplexer A of the digital terrestrial television for the broadcasting of #EstudoEmCasa - Ensino Secundário.

  • ANACOM grants the right to use the short number 2424 to the Shared Services of the Ministry of Health (SPMS) to be used exclusively for sending short messages (SMS) to the population in the context of the implementation of the national vaccination plan against COVID-19, including sending paperless prescriptions and scheduling appointments during that period.
  • ANACOM approves the decision on the identification of undertakings required to contribute to the universal service compensation fund for electronic communications and the setting of the amount of contributions relating to the net costs of the universal service to be compensated for 2019.
  • Publication, on 28 January, of Order No 1151/2021, which defines the minimum set of fixed and mobile broadband Internet access services that comprise the critical services, as well as the order of priority for routing certain categories of traffic.

  • ANACOM approves the provisional measure defining the postal network density targets and minimum service offer objectives to be in force until approval of new targets for postal network density and minimum service offers, in accordance with the provisions of clause 15 of the universal postal service concession contract.

  • ANACOM unanimously elected to chair the Euro-Mediterranean Regulators Group (EMERG) in 2021. ANACOM will have the Regulatory Authorities of Palestine (chairmanship in 2020) and Israel (chairmanship in 2022) as vice-chairs.
