Request to expand the object of the injunction proposed by MEO (Case no. 2122/20.2BELSB)


ANACOM makes public that:

i) Within the scope of Case no. 2122/20.2BELSB, in which MEO – Serviços de Comunicações e Multimédia, S.A. is the applicant and ANACOM is the respondent, ANACOM was notified of a request through which MEO sought "extension of the object of this injunction, requesting suspension of the effects of the decision of ANACOM's Board of Directors of 23 November 2021 (… ) and the title subsequently issued on 15 December 2021, solely to the extent that MEO is made subject to the regulatory obligations whose suspension was requested in the initial application, that is, the obligations (…) set out in articles 42, 44 and 45 of the Regulation", regarding coverage, strengthening of the voice service signal and access to the network [even while the obligations arising from said article 44 of Regulation no. 987-A/ 2020 do not apply to the company].

ii) Such notification may be understood by the competent court as triggering the application of the regime set out in article 128, paragraphs 1 and 2 of Código de Processo nos Tribunais Administrativos (Administrative Courts Procedural Code), by which ANACOM and the interested parties are prevented from initiating or continuing with the execution of administrative acts while the injunction is pending (or, at least, until a reasoned resolution is issued).
