By decision of 29 July 2022 and in compliance with the powers and responsibilities conferred by point f) of paragraph 1 of article 8 of ANACOM’s Statuteshttps://www.anacom.pt/render.jsp?contentId=1351851, the Director-General for Regulation, exercising the powers delegated by the Board of Directors of ANACOM under the terms set out in point i) of paragraph 6 of Determination no. 753/2021https://www.anacom.pt/render.jsp?contentId=1678761 (published on 16 July), decided to grant Orange Business Portugal (Orange) the right of use of '23444xxxx' numbering for provision of the publicly available telephone service at a fixed location in the geographical area of Aveiro, under the terms and conditions set out of the respective title. This decision was taken in pursuit of the regulatory objectives set out in point a) of paragraph 1 of article 5 of LCE - Lei das Comunicações Eletrónicas (Electronic Communications Law)https://www.anacom.pt/render.jsp?contentId=1366216, and in accordance with ANACOM's assigned powers and responsibilities under point d) of paragraph 2 of the same article 5, under the terms of articles 17, 19, 36, 37 of the LCE, and exercising the powers conferred by point b) of paragraph 1 of article 26 and of article 27 of ANACOM’s Statutes.
Orange was made subject to the fulfilment of specific conditions in the exercise of the allocated right, under the terms of article 37 LCE - Lei das Comunicações Eletrónicas (Electronic Communications Law)https://www.anacom.pt/render.jsp?contentId=1366216, specifically as regards use of numbers assigned exclusively for the provision of the telephone service at a fixed location in the respective geographic area, effective and efficient use of the allocated numbers, the guarantee of number portability, and such other principles and criteria that ensure fulfilment of the condition of effective and efficient use as may be established by ANACOM in application of the LCE.
ANACOM also decided to waive the prior hearing of interested parties, pursuant to point f) of paragraph 1 of article 124 of Código do Procedimento Administrativo (Administrative Proceeding Code).
