Launch of the procedure to amend Regulation E112 (Regulation No 99/2009, of 23 February)


Pursuant to paragraph 1 of article 98 of the Administrative Procedure Code, it is hereby made known that the Board of Directors of ANACOM, in the pursuit of the task set out in point l) of paragraph 1 of article 8 of ANACOM’s Statuteshttps://www.anacom.pt/render.jsp?contentId=1351851, approved by Decree-Law No 39/2015, of 16 March 2015, under paragraphs 1, 2, 4 and 6 of article 67 of the Electronic Communications Lawhttps://www.anacom.pt/render.jsp?contentId=1727429, approved by Law No 16/2022, of 16 August, and in the exercise of powers laid down in paragraph 1 of article 10 of Law No 16/2022, of 16 August, and in point a) of paragraph 2 of article 9, in article 10 and in point b) of paragraph 1 of article 26, all of ANACOM’s Statutes, determined on 22 November 2022 to launch the procedure to amend Regulation No 99/2009 of 23 February 2009 on the provision of caller location information to authorities handling emergencies for calls to the single European emergency number 112 (Regulation E112).

This amendment aims to bring the referred Regulation in line with the new legal framework, stemming from the publication of the new Electronic Communications Law, approved by Law No 16/2022 of 16 August, taking also into account the migration of 112 (national emergency number) traffic to IP interconnection and the expected technological developments of the new generation of the 112 service.

In this context, ANACOM’s Board of Directors has decided to set a period of 15 working days from the date of this notice for interested parties to submit contributions and suggestions deemed to be relevant for the preparation of the draft amendment to Regulation E112.

Written contributions, in Portuguese, may be sent until 20 December 2022 to regulamento112@anacom.ptmailto:regulamento112@anacom.pt, stating which elements are considered to be confidential, whereby a version omitting such elements should be submitted.

ANACOM will assess comments and suggestions presented by interested parties, taking them into account in the preparation of the draft regulation, on which interested parties may comment when it is submitted for public consultation, in accordance with article 10 of the Statutes, through publication on ANACOM’s website (www.anacom.pthttps://www.anacom.pt/render.jsp?categoryId=2958) and in Series II of the Official Gazette.
