4rd Questionnaire on intra-European Economic Area communications (following the entry into force of Regulation (EU) 2018/1971, of 11 December, amending Regulation (EU) 2015/2120, of 27 November)



Regulation (EU) 2015/2120, of 27th November, as amended by Regulation (EU) 2018/1971, of 11th December, lays down in its Article 1 common rules to ensure that consumers are not charged excessive prices for interpersonal communications based on numbers originated in the Member State of the national supplier of the consumer and terminated in a fixed or mobile number in another Member State.

Accordingly, as of 15th May 2019, the retail price (excluding VAT) billed to consumers for regulated intra-European Union (EU) communications may not exceed EUR 0.19 per minute for calls, and EUR 0,06 per SMS message. These rules also apply to the remaining countries of the European Economic Area (EEA) - Iceland, Norway and Liechtenstein – from the moment they transpose the regulation.

Furthermore, in accordance with the same article, National Regulatory Authorities shall monitor the market and price developments for regulated intra-EU communications and shall report to the Commission.

The second questionnaire on data collection for intra-EEA1 communications was adopted by the Body of the European Regulators for Electronic Communications (BEREC) for the period from 1 April 2022 to 31 March 2023.

The questionnaire must be completed and sent to ANACOM by mobile and voice fixed service providers, which have a market share above a specific percentage that was set by BEREC, and which do not provide services exclusively to business clients.
