ANACOM notifies the European Commission on relevant markets


ANACOM notified, on May 25, the European Commission and the national regulatory authorities of the remaining EU Member-states, through the Communication & Information Resource Centre Administrator (CIRCA), on the draft measures related to the relevant markets for low bandwidth switched fixed services (retailers and wholesalers, excluding the transit market) and to the analysis of significant market power (SMP) on those markets, pursuant to paragraph no. 1 of Article 57 of Law no. 5/2004, of 10 February (Electronic Communications Law), and within the context of Article 7.3 of Directive 2002/21/CE.

These notices, which do not include the imposition of obligations (an issue to be subject to later consultation and notification), refer to markets 1 to 6 and 8 and 9, of the European Commission Recommendation 2003/311/EC, of 11 February 2003, relating to notices:

1.) Market for narrowband access to the public telephone network at a fixed location for residential customers;

2.) Market for narrowband access to the public telephone network at a fixed location for non-residential customers;

3.) Market for publicly available local and national telephone services provided at a fixed location for residential customers;

4.) Market for publicly available international telephone services provided in a fixed location for residential customers;

5.) Market for publicly available local and national telephone services provided at a fixed location for non-residential customers;

6.) Market for publicly available international telephone services provided at a fixed location for non-residential customers;

8.) Market for call origination on the public telephone network provided at a fixed location; and

9.) Market for call termination on public individual telephone networks provided at a fixed location.

Apart from these markets, ANACOM notified also the market for publicly available telephone calls provided at a fixed location for non-geographic numbers in, outside the scope of said European Commission Recommendation.

Draft decision includes the identified companies with significant market power (SMP):

- Companies of Portugal Telecom operating at the identified relevant markets;

- All fixed network operators exercising in the market for call termination on individual public telephone networks provided at a fixed location (market 9).

The projects now notified took into account the results of the public consultation held between 12 March and 26 April 2004, which final report was approved by ANACOM last 20th of May. The Competition Authority, who was also asked to give an opinion on the definition of markets and the SMP assessments in question, agreed with the analysis and conclusions put forward.
