It was decided by ANACOM, by determinations of 15 and 16 July 2004, to launch a consultation on the obligations regarding wholesale markets for call origination and termination in the public telephone network at a fixed location.
This consultation, which takes place until 10 September 2004, is subject to the general procedure contained in article 8 of Law no. 5/2004, of 10 February, and the respective comments should be written and sent to ANACOM preferably by e-mail, to the address mercadosrtp@anacom.pt.
Being a draft decision, PT Comunicações and the telephone fixed service operators designated as entities with significant market power (SMP) in the market for call termination and individual public telephone networks at a fixed location were notified, within that period of time, to give their opinion, in accordance with the provisions contained in articles 100 and following of the Code of Administrative Procedure.
It was also decided to submit this proposal of decision to the specific consultation procedure, in accordance with the provisions contained in article 57 of said law, which requires to make accessible through an appropriate way, simultaneously to the European Commission and to the national regulatory authorities of the remaining Member-states, the reasoned draft decision stating which information is confidential, and also to notify the European Commission and the national regulatory authorities of the remaining Member-states that the decision project is accessible and howto acced it.
