New model for fixed wireless access (FWA) comprised in administrative rule

Administrative Rule no. 1062/2004 has been published on 25 of August, defining the annual fees, per zone, that are applicable to the use of frequency bands assigned for the fixed wireless access (FWA).

Underlying this Administrative Rule is the new model for usage per zones of those bands, the definition of which is incumbent upon ANACOM, aiming at the recovery of usage rights for frequencies that are not being effectively in use. These bands correspond to those assigned to entities licensed following the tender the Regulation of which was approved by Administrative Rule no. 465-B/99, of 25 June, as well as to those assigned through Order no. 24.237/99 (2nd Series).

Overall, nine zones are defined, the usage of which is subject to the payment of annual fees. The respective formula weights factors such as the value of the radioelectric spectrum unit for each frequency band assigned, the entire radioelectric spectrum assigned and the social impact of the radioelectric spectrum usage in the different zones of the country, based on the social and economic development index.

A new impact is thus intended to be given to the usage of FWA systems, that have not achieved the proportion expected in 1999, thus bringing into line the spectrum needs of operators and the principle of effective usage of frequencies, by means of an appropriate division per zones, and ensuring also that operators who wish to continue using such frequencies may do so.

ANACOM shall in the meantime adapt the qualifying titles already granted, notwithstanding the fact that frequency bands the usage right of which is held by licensed entities may be used in the transmission network.

This statutory instrument, that takes effect as from 1 January 2004, repeals Administrative Rule no. 465-A/99, of 25 June.
