Electronic commerce law published in the Official Gazette


Decree-Law no. 7/2004 was finally published last 7 January, carrying out the transposition into internal law of Directive no. 2000/31/EC of the European Parliament and of the Council of 8 June 2000 (Directive on electronic commerce).

The delay in the publication of this instrument was basically due to obstacles that arose during the preparatory works, which, given the Directive?s horizontal nature and the particular sensitivity of some of the issues dealt with therein, was subject to broad-ranging and active participation by several entities.

A regulation that seeks to discipline some matters that in the context of this measure require special regulation is currently being drafted, namely in what concerns the enrolment of intermediary service providers and the preliminary dispute settlement concerning content available online.
