Definition of relevant markets for low bandwidth switched fixed services and SMP assessment - public consultation

ANACOM launches today, for a period of 30 working days, a public consultation concerning the definition of relevant markets for low bandwidth switched fixed services and the SMP assessment in those markets, in accordance with the provisions contained in the Electronic Communications Law no. 5/2004, of February 10), which grants to the national regulatory authority, ANACOM, the powers to define and analyse the relevant markets, declare the undertakings with significant market power (SMP) and determine the appropriate remedies to be imposed.

The relevant markets definition and SMP assessment process was already subjected to a preliminary public consultation, launched on the 30th of May 2003.  The responses to this preliminary consultation are available in this site – see the "New regulatory framework - Revision 99"https://www.anacom.pt/render.jsp?contentId=130359 page.

On the 6th of June 2003, in the context of the relevant market definition and analysis process, ANACOM launched a data collection process.

The draft decisions concerning the relevant market definition and SMP assessment now submitted to public consultation, are contained in the following documents:

  • Markets for narrowband access to the public telephone network in a fixed location - Definition of relevant markets and SMP assessment;
  • Markets for publicly available telephone services in a fixed location - Definition of relevant markets and SMP assessment;
  • Markets for call origination and termination in the public telephone network in a fixed location - Definition of relevant markets and SMP assessment.

These documents were also submitted to the Competition Authority, pursuant to article 61 of Law no. 5/2004, and to the interested parties, in accordance with articles 100 and 101 of the Administrative Procedural Code.  A deadline of 30 working days was also established for this process.

Pursuant to the general consultation procedure contained in article 8 of the Electronic Communications Law and to the subsequent consultation procedures adopted by ANACOM, the aim of this public consultation is to gather opinions on the overall understanding about the markets definition and analysis and the determination of significant market power.
