Definition of relevant markets for low bandwidth switched fixed services and SMP assessment (public consultation report and draft decision) - determination of 20.5.2004

By determination of 20 May 2004, the public consultation report was approved ? pursuant to paragraph 3 of the 'ICP-ANACOM consultation procedures' - on the definition of relevant markets for low bandwidth switched fixed services and significant market power (SMP) assessment in those markets, excluding transit market. 

Simultaneously, and after hearing the Competition Authority, the corresponding draft project was approved, to be notified to the European Commission and to the national regulatory authorities of the remaining Member-states in accordance with article 57, paragraph no. 1, of Regicom (Law no. 5/2004, of 10 February), which defines the following markets:

i.) Market for narrowband access to the public telephone network in a fixed location for residential customers;
ii.) Market for narrowband access to the public telephone network in a fixed location for non-residential customers;
iii.) Market for local and national telephone services publicly available supplied in a fixed location for residential customers;
iv.) Market for international telephone services publicly available in a fixed location for residential customers;
v.) Market for local and national telephone services publicly available supplied in a fixed location for non-residential customers;
vi.) Market for international telephone services publicly available in a fixed location for non-residential customers;
vii.) Market for telephone services destined to non-geographic numbers publicly available in a fixed location;
viii.) Market for call origination in the public telephone network in a fixed location; and
ix.) Market for call termination in individual public telephone networks in a fixed location.

This draft decision identifies the following companies with significant market power (SMP):

  • Companies from PT Group operating in the identified relevant markets [markets i.) to ix.)]; 
  • All fixed network operators exercising in the market for call termination in individual public telephone networks in a fixed location [market ix.)].
