Opinion-Gathering with regard to the change in Amateur Service legislation


Matters which will be significantly altered

A. NATIONAL AMATEUR CERTIFICATE (CAN):

A1. To create a new CAN model which will permit the holder thereof to operate
any amateur station in accordance with its category.

A2. To abolish the station licence and the subsequent registering of
equipment in the possession of each amateur.

A3. To introduce a limit of two fixed stations for each CAN, the locations of
which will have previously been indicated to the ICP.

B. USE OF NATIONAL AMATEUR STATION:

B1. The use of national amateur stations in Portugal shall only be permitted
to those who hold a CAN and in accordance with the category mentioned therein.

C. AMATEUR CATEGORIES:

C1. To introduce a category D aimed at new amateurs who will only be able to
tap into broadcasts by amateur services, satellite amateurs, radio broadcasts,
as well as the citizen frequency.

D. ADMISSION AND CONTINUANCE IN AMATEUR CATEGORIES:

D1. It shall be obligatory that admission into the Amateur Service be carried
out in category D, by means of an aptitude exam (a test corresponding to the
current "Legislation and Security"). There is a minimum continuance
period of two years in this category.

D2. It shall not be necessary to undergo any test for admission into category
C.

D3. The move to a higher category will presuppose the absence of any
penalties in the preceding 12 months.

E. AMATEUR APTITUDE EXAMS:

E1. Each candidate shall be able to take 3 exams per year, with a minimum
30-day period separating them.

E2. Professional or educational qualifications will not be recognised or
admitted as grounds for not undergoing the exams.

E3. The minimum passing rate in the amateur aptitude exam shall no longer be
50% , but 80%.

F. ATTRIBUTION OF SPECIAL DIALLING CODES::

F1. The attribution of special dialling codes shall be restricted to a
maximum period of 3 consecutive days. It shall also be necessary to present the
respective request at ICP at least 5 working days before.

G. INFRACTIONS:

G1. Establishing communication between fixed stations of the same holder
shall be deemed an infraction.

G2. ICP shall be able to publicise the penalties applied.

H. RATES:

H1. In addition to the rates foreseen in the current regime, an annual rate
shall be created to which all CAN holders shall be subject. It shall replace the
former biannual rate for spectrum use.

H2. Amateur associations shall be exempt from paying the above mentioned
rates, with regards to the stations of which they are holders.

I. CAN CANCELLATION:

I1. The CAN shall be cancelled upon the request or death of its holder.

I2. The CAN can also be cancelled as punishment for infractions deemed
extremely serious, or by repeatedly committing serious infractions.

J. CAN SUSPENSION:

J1. The CAN can be suspended upon the request of its holder.

K. CAN APPREHENSION:

K1. The CAN can be temporarily apprehended as punishment for repeated
infractions deemed serious.

L. INTEGRATIONS

L1. Current amateurs in "category B for those qualified in Morse code
telegraphy" shall be integrated into the future category A.

L2. Current amateurs in "category B for those not qualified in Morse
code telegraphy" shall be integrated into the future category B.

L4. Current holders of tapping codes (CTOxxxx) shall be integrated into the
future category D, upon proof of such status.

M. AMATEUR STATION DIARY

M1. The possibility of making an "amateur station diary" obligatory.

N. CIRCULATION OF DATA RELATED TO THE AMATEUR STATION

N1. The possibility of ICP divulging certain data related to amateur stations
(dialling codes, category, where the station is situated and postal address) to
certain entities (amateur associations or those related to civil and emergency
protection).
