ANACOM prohibits Novis against charging monthly payment for porting numbers


ANACOM has decided to prohibit Novis against charging a two-euro monthly payment, on account of portability, in the Clix/ADSL service provision contracts. The Authority has thus determined upon the operator that it immediately stops advertising this monthly payment for the provision of portability of the PT number, in its website or in any other location whereat the respective provision conditions have been made available. The regulator has also imposed upon the company that it ceases the billing and collecting of the monthly payment within at the most 15 working days.

ANACOM's decision is based on the non compliance of the Clix tariff, which establishes a cost of 2 euros per month for maintaining the PT telephone number (portability), with the Portability Regulation.

Novis must also inform the regulator, within 30 working days, on the new conditions which apply to subscribers with ported numbers and who are currently subject to the two euros monthly charge.

The regulator deems it reasonable that Novis, or any other provider, wishes to be compensated for wholesale costs incurred with number porting, thus charging an additional amount at retail level. It acknowledges that this amount may be divided in several monthly payments, however the respective amount must be fixed in advance and the customer must be made aware of the number of monthly instalments to be paid, before the contract is concluded.

This decision of ANACOM was adopted following several complaints submitted to the regulator by customers of Novis, regarding the billing and collecting by this operator of a monthly payment of 2 euros, for providing the number porting.

The portability is the facility that enables a customer to change operator, while the telephone number remains unaltered.
