Determination of ANACOM regarding the Transit Service provided by PT Comunicações, S.A.
After analysing the proposal for transit service with interconnection at Single and Double Transit levels, with traffic conveyance between PT Comunicações, S.A. and the destination operator supported on PT Comunicações, S.A. circuits, submitted by this operator following the determination of ANACOM's Board of Directors of 23/05/02, it was verified that, maintaining the criteria associated with the said determination, the proposal is broadly compatible with the applicable regulatory principles.
In particular, acknowledging that this service is new in the market and therefore there is some uncertainty in supply evolution, traffic volumes and service provision conditions, which justifies some caution in price definition, there is no reason, at present, to change the proposal submitted by PT Comunicações, S.A. for the transit service using PT Comunicações, S.A. circuits and with interconnection at Single and Double Transit levels, without prejudice of a price revaluation within the global framework of RIO 2003.
Thus, the interested parties being heard pursuant articles 100 and 101 of the Rules of Administrative Procedure and in accordance with the provisions contained in paragraph 1 of article 13 of Decree-Law no. 415/98, and without prejudice of the provisions of paragraph 2 of the above-mentioned article, the ANACOM's Board of Directors decided that PT Comunicações, S.A. must change, within 10 days, the RIO 2002, in order to introduce the applicable conditions, including prices, to the transit service with interconnection at Single and Double Transit levels, with traffic conveyance between PT Comunicações, S.A. and the destination operator interconnection point supported on PT Comunicações, S.A. circuits.
The maximum prices, within the scope of RIO 2002, applicable to transit service using PT Comunicações, S.A. circuits are as follows:
