Report of the analysis made to the reply of Radiomovel to the determination of ICP-ANACOM dated 15.4.2005 and respective action proposal

By determination of 7 December 2005, approval was granted to the conclusion reached by ICP-ANACOM in respect of the assessment of the effective and efficient use of frequencies assigned to Radiomovel and of the obligation concerning the migration of the analogue and digital systems to the CDMA system assigned thereto, following the analysis of the reply submitted by Radiomovel to the determination of 15 April 2005, and the report prepared thereafter. Under the approved determination, the following was decided:

1º To fully approve the report and action proposal presented by the established commission, based on elements of fact and law comprised therein;

2º To notify Radiomovel, pursuant to paragraph 4 of article 110 of Law no. 5/2004, of 10 February, and in order to ensure compliance with the principle of effective and efficient use of frequencies, set out in point c) of paragraph 2 of article 15 thereof, to present to ICP-ANACOM, within a 60-day deadline – which may be extended at the request of  the interested party -, a plan that adapts the Mobile Service with Shared Resources (SMRP) as well as carrier frequencies assigned thereto, to the current and expected evolution of the implementation of provided network and services.

The referred plan, which must prepared with reference to the period of time between the date of notification of the decision of ICP-ANACOM and the end of the period of validity of the right of use assigned to Radiomovel (14.10.2008), should include:

1. Scheduled date for the conclusion of the migration process of MPT1327 technology clients to the CDMA system;

2. An estimate of the number of subscribers and terminals using SMRP-CDMA systems during the reference period;

3. Coverage plan and scheduling for the continental national territory according to the CDMA technology system, including in particular the number of base stations to be implemented;

4. Detailed network project, namely as regards the radio access network, including the following elements:

a) Features of provided services/facilities, based on the project presented to ICP-ANACOM in February 2002, including:

i) “Push-to-talk (PTT)” – voice;
ii) Group calls;
iii) Dispatch services;
iv) Data or Status Short Messages;
v) High-speed data (specifying at least Image and File Transfer and Video Transmission);
vi) Positioning Services;
vii) Access to/interaction with Databases.

b) Features of target market (s)/segments;

c) Detailed features of expected traffic in access network, by reference to 2007, providing for services indicated in point a), the relative proportion (%) of each service in total traffic.  The expectations for intranet and internet traffic (%) in view of total traffic shall also be identified and justified;

d) Explanation of criteria used to dimension access radio network, taking into account the traffic determined above and adopted criteria of quality (which should be likewise explained), specifying also the coverage plan, as well as the capacity of the access radio network. At the least the following data shall be provided:

i) Transmitter-receivers (v.g. power and sensitivity) and respective rules;
ii) Antennas used (Type, Gain, Radiation Diaphragm);
iii) Accessories used (v.g. Cables, Filters and Combiners);
iv)  Spread models;
v) Available capacity in each Base Station and variations according to services available and/or expected;
vi) Map identifying base stations and respective Radioelectric coverage;

e) Determination of spectral efficiency of network planning considering Erl/km²/MHz and/or kbit/s/km²/MHz;

f) Other elements deemed relevant.

5. Indication of measures to be adopted by the company that maintain the SMRP nature, being a service aimed at closed user groups.
