Alterations to be introduced to the RIO 2002 (clarifications)
Subsequent to the determination by ANACOM's Board of Directors of 23/05/02, regarding alterations to be introduced in the RIO 2002https://www.anacom.pt/render.jsp?contentId=419091 https://www.anacom.pt/render.jsp?contentId=419095, PT Comunicações, S.A., via faxes dated 06/06/02 and 14/06/02, requested clarifications and presented its understanding on several of the matters integrated therein and also communicated the publication of the RIO 2002. Other entities also expressed certain concerns regarding the terms of the RIO 2002 published by PT Comunicações, S.A.
The matters addressed essentially concern the following:
a) The price to be applied to portability;
b) The date on which the prices of origination, termination and transit services, portability service and other services will enter into force;
c) Inclusion in the RIO of the principle of balanced distribution of traffic in the call termination service;
d) The remuneration to be applied to access to the 1414 - Life Line service;
e) Recognition of the moment on which a fault begins;
f) Information for the purposes of billing outgoing international calls.
Having analysed these matters and reviewed the RIO published on 12/06/02, ANACOM's Board of Directors on 31/07/02, determined the following:
1. In accordance with the determination of 23/05/02, PT Comunicações, S.A.'s price list for portability should specify a maximum price, that in the case of porting a simple access shall be EUR 15 and in the case of porting blocks of contiguous numbers shall be the lower of the following two amounts: (i) EUR 15 for each number in the block (ii) the price applied by the Entidade de Referência, which depends on the size of the block of numbers to be ported and the number of porting operations carried out by all service providers in the previous quarter.
2. In relation to prices to be applied to termination, origination and transit services, the understanding expressed in the determination of 23/05/02, regarding the entry into force of prices on 01/05/02, is confirmed. In relation to the prices of other services, specifically the billing and collection service, the transport service for outgoing international traffic and the portability service, these prices should enter into force on the date of publication of the RIO 2002 (12/06/02).
3. In regards to the call termination service, the terms of the determination of 23/05/02 are reiterated, whereby it is recommended that operators must respect, whenever possible, the referred interconnection principles, which, due to the fact that they are intrinsically related to the management of the operator's network, should not be inscribed within the RIO.
4. In principle, free of charge remuneration of interconnection in access to the 1414 - Life Line service presupposes the existence of an agreement between the various parties involved.
5. In regards to point 3.5 of Annex 4 of the RIO 2002, the terms of the determination of 23/05/02 are reiterated. To this effect, PT Comunicações, S.A. must initially accept the notification of any fault, although it may be subsequently classified, and duly justified, as non-existent following a suitable investigation. PT Comunicações, S.A. must thus modify the text of the RIO 2002 in order that the start time of the fault will be counted from the moment on which the respective notification is sent by the operator.
6. In regards to the transport service for outgoing international traffic, PT Comunicações, S.A. must undertake a full and coherent revision of the RIO 2002, introducing a table for international calls, describing the information that PT Comunicações, S.A. supplies for the purposes of billing interconnection traffic (Annex 6 of the RIO 2002).
PT Comunicações, S.A., under the terms of article 13 of Decree-Law no. 415/98, must adjust the RIO 2002, in conformity with the aforementioned clarifications, within a maximum of 10 days.
