Operating conditions of the voice mail service
By resolution dated March 6, 2002, a decision project was approved with ANACOM's understanding according to which the resolution of June 2, 1999 is applicable to all operators and providers of telecommunications services of public use that are currently entitled to provide the voice mail service. Following that former resolution, the terrestrial mobile service operators and PT Comunicações, at the time the only fixed telephone service provider, were bound to ensure a period not lower than 5 seconds after the beginning of the voice mail service message with no cost to the calling user, enabling the choice between using, or not, said functionality. Thus, the consumers of telecommunications services are protected against being obliged to pay for a service that they did not previously and expressly requested, ensuring the effective compliance with the consumer protection law (article 9, no. 4 of Law no. 24/96, of July 31).
This decision project was notified to the interested parties for them to give their written opinion within 10 days pursuant to Articles 100 and 101 of the Administrative Procedural Code.
