Determination of ICP-ANACOM on ''PT ADSL Network'' Offer
At present, the local access installation price practised within the scope of the ''PT ADSL Network'' wholesale offer amounts to € 70.00 (without VAT), in the modality provision without splitter installation and without visit (self-installation). This provision modality is applicable to class 0 - 512 kbps / 128 kbps and class 1 - 256 kbps / 128 kbps.
However, the price actually practised by Portugal Telecom, SGPS subsidiary companies for the activation of the service in the retail market amounts to € 42.02 (without VAT), an amount which is significantly lower than the corresponding wholesale price.
Thus, taking also into account the relative share of the PT Group of companies in terms of broadband accesses and, namely, in terms of ADSL accesses (in which the subsidiary companies of Portugal Telecom, SGPS had, at the end of 2003, a market share of 85%), as well as the relevance of the prices of the ADSL wholesale offers for the broadband and information society development, the Board of Directors of ICP-ANACOM, within the scope of its duties foreseen in article 6, no. 1, subsection b) of its Statutes, approved by Decree-Law no. 309/2001, of December 7th, decided, pursuant to paragraph no. 4 of article 33 of Decree-Law no. 474/99:
1. To fix € 38 for the maximum price of the local access installation service in the “PT ADSL Network” wholesale offer, for class 0 - 512 kbps / 128 kbps and for class 1 - 256 kbps / 128 kbps;
2. To reduce to € 16 the local access monthly fee of class 0 - 512 kbps / 128 kbps.
These conditions will be in force as from 26th January 2004.
