Roaming - ANACOM authorises agreement between Oni Way and TMN

The Autoridade Nacional de Comunicações (ANACOM) has approved the roaming agreement established between the operators Oni Way and TMN, in light of the fact that the agreement respects the rules established for this market.

In this manner, Oni Way may provide services using TMN' s network. ANACOM has also decided that this agreement must include the use of third generation network elements and terminal equipment, although on an experimental basis.

The analysis conducted by ANACOM concluded that the provision of services, within the framework of this agreement, may have a positive impact on the current state of competition in the Portuguese mobile market, on job creation and satisfaction of public interest obligations assumed by licensed operators.

It is to be hoped that in this manner operators, users and equipment manufacturers will fine tune their readiness for third generation mobile systems and feel more encouraged to develop UMTS networks and services.

The analysis conducted by ANACOM also considers that the agreement may have a positive impact on public interest objectives, in particular the satisfaction of commitments assumed by the licensed operators with the State, in terms of citizen's access to multimedia services that foster the development of the Information Society.

At the same time, ANACOM definitively rejected the request formalised by Oni Way for DCS 1800 frequencies, since it considered that there were not due grounds for justifying the attribution of a fourth license for the said technology.

It was decided that, in these circumstances, there are no grounds for the assignment of frequencies given the current state of the market, mobile operators' licensing rules and the radio spectrum management framework.
