Frequency usage rights of RTP for analogue television broadcasting

By determination of 12 March 2008, and following the general consultation procedure launched in accordance with the determination of 3 January 2008, it has been decided:

1. To approve, under the terms of and with the grounds set out therein, the final report of the general consultation procedure;

2. Include, among the conditions governing the frequency usage rights under the terms of article 32 of Law no. 5/2004 of 10 February and on the title to be issued to Rádio e Televisão de Portugal, S.A. for the exercise of the activity of analogue television broadcasting in respect of the programming services of RTP 1, RTP 2, RTP Açores and RTP Madeira, the recuperation by ICP-ANACOM, without cost, of the frequencies concerned, following the amendments made to the NFAP (National frequency Allocation Plan), particularly upon the establishment, under legal terms, of the date for the switch off of analogue system television transmissions;

3. Submit the terms of the title to a prior hearing of Rádio e Televisão de Portugal, S.A. under the terms and for the purposes of the provisions of article 100 and 101 of the Code of Administrative Procedure, whereby a period of 10 working days is provided for this company to respond.
