99 Revision Consultations


The comments received within the scope of the several public consultations promoted by the Commission regarding the new regulatory framework applicable to the electronic communications networks and services ("99 Revision") are available in the European Union website, namely the Framework Directive - Directive 2002/21/EC, of 7 March 2002.

Specifically worth of mention is the consultation on the Draft Recommendation on relevant product and service markets within the electronic Communications sector susceptible to ex ante regulation in accordance with Article 15 of said Directive, which was held between June 18 and July 31, 2002 and which also led to a public hearing held in Brussels on July 3.  The available comments are organized in accordance with the nature of the entities that prepared them:  regulators (including ANACOM and IRG - Independent Regulators Group, among others) and associations, operators and radio broadcasters (containing the contributions of some national operators, such as  Onitelecom and Portugal Telecom).

It is also possible to have access to the comments submitted on the List of standards and/or specifications for electronic communications (networks, services and associated facilities) submitted to public consultation by the Commission on 5 July 2002 in accordance with article 17 of the Framework-Directive.

Still within the scope of the Framework-Directive (article 14) - the Commission Guidelines on analysis and evaluation of significant market power under the new community regulatory framework were recently published on 11 July 2002, also subject to an equal and preliminary public hearing (pursuant to News of  12/07/2002https://www.anacom.pt/render.jsp?contentId=55630)

To complete this "package", Directive 2002/77/EC from the Commission was also published (European Community Official Journal L249 of 17/09/2002http://europa.eu.int/eur-lex/pri/en/oj/dat/2002/l_249/l_24920020917en00210026.pdf) of 16 September 2002, on competition in the markets for electronic communications networks and services, which revokes, as from 25 July 2003 (enforcement date of the new regulatory framework), Directive 90/388/CE from the Commission, of 28 June 1990, with all the amendments introduced afterwards.  This new Directive consolidates, on the one hand, the legal framework currently in force and, on the other hand, by adapting and clarifying their content, namely in terms of definitions, in view of the technological evolution that took place in the communications sector and the convergence phenomena.
