By determination of 15 October 2008, ANACOM decided to launch a public consultation on amendments to the Portability Regulation (Regulation no. 58/2005 of 18 August).
This draft amendment stresses on the one hand the liability of the receiving provider throughout the whole portability process, having been defined rules of effectiveness between providers and strengthened subscriber protection, by providing for monetary compensation in situations of fault or negligence, between providers and relatively to the subscriber, as well as for deadlines for activating portability to the subscriber. On the other hand, provision is made for a solution that enables the portability of numbers of subscribers and prior subscribers of companies that terminate the service, to whom such facility must also be guaranteed.
This draft amendment is subject to the regulatory procedure provided for in article 11 of ANACOM's Statutes, as well as to the general consultation procedure established in article 8 of the Electronic Communications Law, a period of 30 working days having been set for comments, taking into account consultation procedures approved by this Authority in February 2004. The deadline for reception of comments, which must be sent preferably by email to "regportabilidade@anacom.pt", thus expires on 2 December 2008.
Once the consultation procedure has been completed, received replies shall be disclosed in this website. For this reason, interested parties are requested to state clearly the elements deemed to be confidential.
