Wholesale offers - Publication of performance levels


ANACOM has decided, by determination of 11 March 2009, to approve the final decision on the publication, by Grupo PT, of the levels of performance in quality of service (QoS) in the following wholesale offers: RUO (reference unbundling offer), LLRO (leased lines reference offer), RCAO (reference conduit access offer), Rede ADSL PT and SLRO (subscriber line resale offer).

Likewise, approval was given to the prior hearing held on the draft decision, approved by determination of 15 October 2008, in respect of which comments were received from the following entities: OniTelecom, Vodafone Portugal, Rádio e Televisão de Portugal, Sonaecom, ZON Multimédia and Grupo PT.

According to the approved decision, Grupo PT shall provide and disclose the information outlined in Appendix 2 of the determination to end users, the beneficiaries of its wholesale offers and to ANACOM. Accordingly, the information provided to end users shall be made available on the website of Grupo PT, in a form which has good visibility and is easily identifiable, while information provided to the beneficiaries of these offers shall be made available through an Extranet, or where, with grounds, this is not possible, by email.

Taking utmost account of all the comments received with respect to the prior hearing procedure, ANACOM considers that there are no grounds for making fundamental changes to the draft approved on 15 October 2008. However, a number of clarifications were introduced, specifically with respect to the meaning of some of the indicators in Appendix 2, the provision of information to end users, which must be accompanied by an explanatory note to clarify the scope and extent of information available, while Grupo PT does not need to communicate that information was published.

It was also clarified that ''for each company/internal  department of Grupo PT which does not use the wholesale offers concerned, but which provide services encompassed by said offer or are provided with services according to said offers, information shall be published on the respective levels of service, using the indicators set out in the reference offers.''

ANACOM likewise accepted that Grupo PT will provide the information in the formats defined in the determination now adopted from October 2009, and not from July 2009, as set out in the draft decision, with respect to the indicators which are currently made available to this Authority. For the remaining indicators, the information shall be published 3 months afterwards.
