EXPLANATORY MEMORANDUM

1 INTRODUCTION

A number of ERC Decisions were adopted for regulating the harmonised use of short range devices in the past. By the adoption of ERC Recommendation 70-03, these regulations and the frequency bands to be used by the short range devices were included in specific annexes to this recommendation. In addition, with the adoption of harmonised standards by ETSI, some of these ERC Decisions have become obsolete. The first five ERC Decisions, which will be withdrawn with the adoption of this ECC Decision, are related to the harmonised frequencies, technical characteristics and exemption from individual licensing of various Short Range Devices. And they are considered obsolete for the reasons given above.

The last ERC Decision to be withdrawn with the adoption of this ECC Decision is ERC/DEC(01)21, on the Direct Mode Operation (DMO) of the Digital Land Mobile Systems operating in the frequency band 445.2-445.3 MHz. Investigations showed that there was no information concerning the availability of this equipment in Europe. Since there is no equipment in the market to be used in accordance with this ERC Decision, this Decision has also become obsolete.

2 BACKGROUND

ECC agreed in 2004 to begin a review of all ERC/ECC Decisions to consider the impact of convergence of services and technology on the spectrum regulatory framework and consider whether any elements should be modified while assessing what benefits such action would bring. In addition, it was agreed that each ECC Decision will be reviewed by the ECC every three years from its date of adoption to determine the extent of its implementation and the take-up of any frequency bands designated in the Decision. As a consequence of this review the ECC Plenary would decide whether to maintain, revise or abrogate existing Decisions.

These six Decisions were reviewed in the light of ECC agreement for review, and found that they are not used any more. Therefore, they have become obsolete and there is no need to maintain them any more.

3 REQUIREMENT FOR AN ECC DECISION

The ECC Rules of Procedure foresee that the withdrawal of a Decision is subject to the same procedure as the development and adoption of a new Decision. This Decision therefore dictates the withdrawal of ERC/DEC(97)06, ERC/DEC(01)01, ERC/DEC(01)05, ERC/DEC(01)06, ERC/DEC(01)14 and ERC/DEC(01)21.

''The European Conference of Postal and Telecommunications Administrations,

considering

a) that, by the adoption of ERC Recommendation 70-03, these regulations and the frequency bands to be used by the short range devices were included in specific annexes to this recommendation. In addition, with the adoption of harmonised standards by ETSI, the ERC Decisions related to SRDs have become obsolete.

b) that, there is no equipment in the market to be used in accordance with the ERC/DEC(01)21, and therefore this Decision has also become obsolete.

DECIDES

1. to withdraw the ERC/DEC(97)06 - ERC Decision of 30 June 1997 on the harmonised frequency band to be designated for Social Alarm Systems;

2. to withdraw the ERC/DEC(01)01 - ERC Decision of 12 March 2001 on harmonised frequencies, technical characteristics and exemption from individual licensing of Non-specific Short Range Devices operating in the frequency bands 6765 - 6795 kHz and 13.553 - 13.567 MHz;

3. to withdraw the ERC/DEC(01)05 - ERC Decision of 12 March 2001 on harmonised frequencies, technical characteristics and exemption from individual licensing of Non-specific Short Range Devices operating in the frequency band 2400 - 2483.5 MHz;

4. to withdraw the ERC/DEC(01)06 - ERC Decision of 12 March 2001 on harmonised frequencies, technical characteristics and exemption from individual licensing of Non-specific Short Range Devices operating in the frequency band 5725 - 5875 MHz;

5. to withdraw the ERC/DEC(01)14 - ERC Decision of 12 March 2001 on harmonised frequencies, technical characteristics and exemption from individual licensing of Short Range Devices used for inductive applications operating in the frequency bands 6765 - 6795 kHz, 13.553 - 13.567 MHz;

6. to withdraw the ERC/DEC(01)21 - ERC Decision of 12 March 2001 on harmonised frequency band to be designated for the Direct Mode Operation (DMO) of the Digital Land Mobile Systems;

7. that this Decision enters into force on 14 March 2008.''
