EXPLANATORY MEMORANDUM
1 INTRODUCTION
Based on market forecasts and requests from industry, CEPT has designated spectrum and provided relevant regulatory provisions for ERMES in a number of ERC Recommendations and ERC Decisions.
In 1994 the ERC adopted ERC/DEC/(94)02 on the frequency band to be designated for the coordinated introduction of the European Radio Messaging System (ERMES) and identified the frequency band 169.4125 - 169.8125 MHz for this purpose. In 1998, ERC/DEC/(98)23 on exemption from individual licensing of ERMES receivers was adopted in order to make the national licensing regimes as simple as possible and to minimise the burden upon Administrations and users of the equipment.
A survey carried out by the European Radiocommunications Office (ERO) at the end of 2001 showed that in most CEPT countries the frequency band 169.4125 - 169.8125 MHz was no longer used for the ERMES systems. The actual development of subscriber numbers in ERMES networks had not met the forecasted numbers. In June 2003 the European Commission issued a mandate to CEPT to review future possible applications for the band 169.4 - 169.8 MHz in the light of Community policies. Following the outcome of this review, the ECC issued Decision ECC/DEC/(05)03, which withdrew Decision ERC/DEC/(94)02.
2 BACKGROUND
Based on the above mentioned survey, CEPT administrations agreed that there is no need for the ERMES Decision. The ECC subsequently adopted Decision ECC/DEC/(05)02 in order to make it possible for new applications to use the frequency band 169.4 -169.8125 MHz. Also, Decision ECC/DEC/(05)03 provided for the withdrawal of Decision ERC/DEC/(94)02. Therefore, any regulatory provisions concerning the ERMES system, including a licensing regime, are unnecessary and Decision ERC/DEC/(98)23 needs to be withdrawn.
3 REQUIREMENT FOR AN ECC DECISION
The ECC Rules of Procedure foresee that the withdrawal of a Decision is subject to the same procedure as the development and adoption of a new Decision. This Decision therefore dictates the withdrawal of ERC/DEC/(98)23 on Exemption from Individual Licensing of ERMES paging receivers.

''The European Conference of Postal and Telecommunications Administrations,
considering
a) that CEPT has designated spectrum and provided relevant regulatory provisions for ERMES in a number of ERC Recommendations and ERC Decisions over the years;
b) that based on low market penetration, the ECC in 2005 decided to withdraw the ERC Decision on the frequency band to be designated for the coordinated introduction of the European Radio Messaging System (ERMES) (ERC/DEC/(94)02);
c) that CEPT Recommendation T/R 25-07 regarding the band 169.4125 - 169.8125 MHz remains in force in relation to the paging and other incumbent systems that remain operational in the band;
d) that the ECC has adopted a new ECC Decision (ECC/DEC/(05)02) on the use of the frequency band 169.4 – 169.8125 MHz which makes the Decision on exemption from individual licensing of the receivers outdated.
DECIDES
1. to withdraw the ERC Decision on exemption from individual licensing of ERMES paging receivers (ERC/DEC/(98)23);
2. that this Decision enters into force on 14 March 2008.''
