EXPLANATORY MEMORANDUM
1 INTRODUCTION
ECC has adopted ECC/DEC/(06)03 of 24 March 2006 on ''Exemption from Individual Licensing of High e.i.r.p. Satellite Terminals (HEST) with e.i.r.p. above 34 dBW operating within the frequency bands 10.70 - 12.75 GHz or 19.70 - 20.20 GHz space-to-Earth and 14.00 - 14.25 GHz or 29.50 - 30.00 GHz Earth-to-space''.
The ECC in its March 2006 meeting at Oulu reviewed the proposal made by WGRA in January 2006 to review the SIT, SUT and VSAT ERC/DEC/(00)03, ERC/DEC/(00)04, ERC/DEC/(00)05, which are superseded by the above ECC/DEC/(06)03.
The ECC has agreed that the above Decisions could be withdrawn.
The details of these Decisions are given in the next section.
2 BACKGROUND
ECC agreed in 2004 to begin a review of all ERC/ECC Decisions to consider the impact of convergence of services and technology on the spectrum regulatory framework and consider whether any elements should be modified while assessing what benefits such action would bring. In addition, it was agreed that each ECC Decision will be reviewed by the ECC every three years from its date of adoption to determine the extent of its implementation and the take-up of any frequency bands designated in the Decision. As a consequence of this review the ECC Plenary would decide whether to maintain, revise or abrogate existing Decisions.
3 REQUIREMENT FOR AN ECC DECISION
The following Decisions relate to Satellite Interactive terminals, Satellite User terminals and Very Small aperture Terminals. The above Decisions and their requirements are included in the new ECC/DEC/(06)03 HEST, and therefore the above Decisions can now be considered for withdrawal.
The ECC Rules of Procedure foresee that the withdrawal of a Decision is subject to the same procedure as the development and adoption of a new Decision. Consequently the following ERC/ECC Decisions should be withdrawn:
ERC/DEC/(00)03 of 27 March 2000 on Exemption from Individual Licensing of Satellite Interactive Terminals (SITs) operating within the Frequency Bands 10.70 - 12.75 GHz space-to-Earth and 29.50 - 30.00 GHz Earth-to-space.
ERC/DEC/(00)04 of 27 March 2000 on Exemption from Individual Licensing of Satellite User Terminals (SUTs) operating within the Frequency Bands 19.70 - 20.20 GHz space-to-Earth and 29.50 - 30.00 GHz Earth-to-space.
ERC/DEC/(00)05 of 27 March 2000 on Exemption from Individual Licensing of Very Small Aperture Terminals (VSAT) operating in the frequency bands 14.0 - 14.25 GHz Earth-to-space and 12.5 - 12.75 GHz space-to-Earth.

''The European Conference of Postal and Telecommunications Administrations,
considering
a) that the ECC has adopted ECC/DEC/(06)03 for High E.I.R.P Satellite Terminals (HEST) and as a consequence the SIT, SUT and VSAT Decisions are no longer required.
b) that these Decisions shall be withdrawn on 26 March 2009 in order to allow administrations to make necessary adaptations to their legal frameworks, as required;
c) that the existing ERC Decisions relating to free circulation and use and licence exemption for these systems are no longer required.
DECIDES
1. to withdraw Decision ERC/DEC/(00)03 of 27 March 2000 on Exemption from Individual Licensing of Satellite Interactive Terminals (SITs) operating within the frequency bands 10.70 - 12.75 GHz space-to-Earth and 29.50 - 30.00 GHz Earth-to-space;
2. to withdraw Decision ERC/DEC/(00)04 of 27 March 2000 on Exemption from Individual Licensing of Satellite User Terminals (SUTs) operating within the frequency bands 19.70 - 20.20 GHz space-to-Earth and 29.50 - 30.00 GHz Earth-to-space;
3. to withdraw Decision ERC/DEC/(00)05 of 27 March 2000 on Exemption from Individual Licensing of Very Small Aperture Terminals (VSAT) operating in the frequency bands 14.0 - 14.25 GHz Earth-to-space and 12.5 - 12.75 GHz space-to-Earth;
4. that this Decision enters into force on 26 March 2009.''
