on the withdrawal of ERC Decisions

EXPLANATORY MEMORANDUM

1 INTRODUCTION

In January 2006 several MSS Decisions were reviewed and it was determined that four of these were suitable for withdrawal as the equipments referenced was no longer operational. WGRA in March 2006 endorsed that view and the ECC in March 2006 confirmed this view. However, at that time a formal ECC procedure to allow abrogation of old Decisions had not been adopted. Therefore, the withdrawal of the affected Decisions was done on a 'preliminary' basis, waiting development of the ECC Decision template document that should be used for withdrawal. The procedure is now in place and this ECC Decision is the final step in completing withdrawal of those Decisions.

The concerned ERC Decisions are ERC/DEC/(98)03, ERC/DEC/(98)17, ERC/DEC/(98)18, and  ERC/DEC/(98)24.

The details of these Decisions are given in the next section.

Recent meetings of the ECC have reconfirmed to WGFM that these Decisions should be taken into account in the development of working papers seeking withdrawal of old Decisions.

2 BACKGROUND

ECC agreed in 2004 to begin a review of all ERC/ECC Decisions to consider the impact of convergence of services and technology on the spectrum regulatory framework and consider whether any elements should be modified while assessing what benefits such action would bring. In addition, it was agreed that each ECC Decision will be reviewed by the ECC every three years from its date of adoption to determine the extent of its implementation and the take-up of any frequency bands designated in the Decision. As a consequence of this review the ECC Plenary would decide whether to maintain, revise or abrogate existing Decisions.

3 REQUIREMENT FOR AN ECC DECISION

The ECC Rules of Procedure foresee that the withdrawal of a Decision is subject to the same procedure as the development and adoption of a new Decision.

The following Decisions relate to PRODAT and ARCANET equipment that is no longer in use and consequently the following ERC Decisions are to be withdrawn:

ERC Decision ERC/DEC/(98)17 of 23 November 1998 on Exemption from Individual Licensing of ARCANET Suitcase terminals,

ERC Decision ERC/DEC/(98)18 of 23 November 1998 on Exemption from Individual Licensing of EMS-PRODAT terminals for land mobile applications,

ERC Decision ERC/DEC/(98)24 of 23 November 1998 on free circulation and use of ARCANET Suitcase terminals in CEPT member countries enlarging the field of application on ERC/DEC/(95)01.

''The European Conference of Postal and Telecommunications Administrations,

considering

a) that the PRODAT and ARCANET satellite systems are no longer in operational use.

b) that the existing ERC Decisions relating to free circulation and use and licence exemption for these systems are no longer required.

DECIDES

1. to withdraw the ERC Decision ERC/DEC/(98)03 of 20 March 1998 on free circulation and use of EMS-PRODAT terminals in CEPT member countries enlarging the field of application of ERC/DEC/(95)01.

2. to withdraw the ERC Decision ERC/DEC/(98)17 of 23 November 1998 on Exemption from Individual Licensing of ARCANET Suitcase terminals.

3. to withdraw the ERC Decision ERC/DEC/(98)18 of 23 November 1998 on Exemption from Individual Licensing of EMS-PRODAT terminals for land mobile applications.

4. to withdraw the ERC Decision ERC/DEC/(98)24 of 23 November 1998 on free circulation and use of  ARCANET Suitcase terminals in CEPT member countries enlarging the field of application on ERC/DEC/(95)01.

5. that this Decision enters into force on  27 June 2008.''
