Consultation concerning the regulation on the settlement and collection of fees


As per determination of 25 March 2009, ANACOM approved the draft Regulation on the posting, settlement and collection of fees due to this Authority, taking into account that this matter is not covered by Administrative Rule no. 1473-B/2008 of 17 December, which is limited to defining the amount of the fees, the periodicity of their settlement, and, in the isolated case of fees due for the operation of the activity of provider of publicly available electronic communications networks and services, the sending to this Authority of a statement indicating the amount of relevant revenues directly related to the activity's operation in the previous calendar year.

Therefore, given the inexistence of a uniform regulation on the posting, settlement and collection of fees to be collect by ANACOM, which prevents the transparent identification of the rules applying to the payment of the mentioned fees, this Authority decided, under its regulatory powers, to create a regulation aiming to simplify the procedure for the posting, settlement and collection of fees, enabling operators, on one hand, to know the general regime applying to the posting, settlement and collection of fees to  be collect by ANACOM, and, on the other hand, to know each fee’s substantive regime.

This draft is subject to the regulatory procedure foreseen in article 11 of ANACOM's Statutes and a 30 working days period has been set for interested parties to comment.

Thus, the deadline for receiving comments is 18 May 2009. These comments should preferably be sent by e-mail, to the address "regulamento_taxas@anacom.pt".

Once the consultation process is concluded, the received comments will be publicly released, on this website, and therefore interested parties should clearly indicate the elements that they consider confidential.

ANACOM took the initiative to publish, as from today, a notice publicizing the approval of the draft regulation on several national and regional press media: Diário Económico, Público, Expresso, Açoriano Oriental and Jornal de Notícias da Madeira.
