Call termination on mobile networks - Court rejects operators' claims


The Tribunal Administrativo de Círculo de Lisboa (Administrative Circuit Court for Lisbon) has dismissed the claims made by TMN - Telecomunicações Móveis Nacionais, seeking an order suspending the effects of ANACOM?s  determination of 2 July 2008, on the specification of the price control obligation with respect to the wholesale market for voice call termination on individual mobile networks, deeming that the ancillary purpose of the interim measure relatively to the main claim had not been established, and that the order suspending the effects of the  determination would seriously undermine the public interest, outweighing the benefits on the side of the applicant.

This Court had also delivered judgment on a similar claim made by Vodafone Portugal, which was also rejected, in a ruling which in the meantime was confirmed by the Tribunal Central Administrativo Sul (Second Instance Administrative Court) in the scope on an appeal lodged by Vodafone Portugal.
