By determination of 5 August 2009, ANACOM approved a final decision on the administrative settlement proceedings concerning a portability dispute opposing ZON TV Cabo Portugal (ZON) and PT Comunicações (PTC), further to an application submitted by ZON pursuant to article 10 of the Electronic Communications Law.
According to this decision, ANACOM rejected ZON’s claims, save for those concerning refusal of electronic portability requests based on failure to terminate or alter the contract, by transmission of the “301” error code, refusal of electronic requests based on the alleged non-portable nature of numbers, on account of such numbers concerning public pay-phones, and also violation of confidentiality obligations, facts which shall be assessed at the level of legal litigation.
