By determination of 19 August 2009, ANACOM issued a draft decision revoking the act granting licence no. ICP-11/99-FWA to BRAGATEL – Companhia de Televisão por Cabo de Braga, for the operation of fixed wireless access (FWA) systems and ordering the corresponding recovery of the allocated right of use for frequencies, with effect from 1 January 2004. ANACOM decided also to reject the application for retroactive effect of the revoking act with effect from the date on which the license was issued.
Pursuant to the Administrative Procedure Code, ZON TV Cabo Portugal (further to the merger by incorporation which took place in the meantime) was given a time-limit of 10 working days to assess the matter in writing, if the company so wishes.
