Pursuant to paragraphs 2 and 6 of article 21 of the Statutes of ICP - National Communications Authority (ICP-ANACOM), approved by Decree-Law no. 309/2001 of 7 December, the members of the Board of Directors are appointed by resolution of the Council of Ministers, upon proposal of the member of the Government responsible for the communications area, for a non-renewable term of five years. On the other hand, paragraph 3 of article 23 of this Decree-Law establishes that in case of individual cessation of mandate, the new member is always appointed for a five-year period.

Pursuant to Resolution no. 61/2002 (II Series) of 4 July, the three members of the Board of Directors of ICP-ANACOM were appointed, under article 21 of the respective Statutes.

In the meantime, José Alfredo de Carvalho Saraiva Mendes, who had been appointed as member of the Board of Directors of ICP-ANACOM, under the mentioned Resolution no.61/2002, requested the resignation from his post of the member of the Government responsible for the communications area, having his resignation been accepted by order of the Deputy Secretary of State for Public Works and Communications, in the scope of powers delegated by the Minister for Public Works, Transport and Communications, on 5 January 2006.

On the other hand, through Resolution no. 52/2006 (II Series), the Government removed, at his own request, Pedro Duarte Neves from the post of Chairman of the Board of Directors of ICP-ANACOM, for which he had been appointed by Resolution no. 88/2004 (II Series) of 30 July, although he has remained in office, under paragraph 6 of article 21 of the referred Statutes.

Having regard to the responsibilities and assignments of ICP-ANACOM, namely to assist the Government in the definition of strategic guidelines and general policies for communications and the activity of communications operators, and to assure regulation and oversight of the communications sector, it is fundamental and urgent to empower de Board of Directors with the competences necessary for it to function, namely the operational ability necessary in order to meet the responsibilities and assignments mentioned above, as well as to pursue the internal restructuring according to the guidelines of the PRACE- Programa de Reestruturação da Administração Central do Estado (Central Public Administration Restructuring Programme).

Within this context, and pursuant to paragraph 1 of article 21 of the Statutes of ICP-ANACOM, the umbrella executive body of ICP-ANACOM must be endowed with several technical assets enabling it to meet the dynamic and complex nature of the sector and of the many regulated markets, by resorting to people of recognised capacity, independence and technical and professional skills.

Therefore:

Pursuant to article 21 of the Statutes of ICP-ANACOM, approved by Decree-Law no. 309/2001 of 7 December, and under point d) of article 199 of the Constitution, the Council of Ministers hereby resolves:

1 - To appoint, following a proposal put forward by the Minister for Public Works, Transport and Communications. the following members of the Board of Directors of ICP - National Communications Authority (ICP-ANACOM), as follows:

Chairman - José Manuel Amado da Silva.
Vice-Chairman - Alberto Souto de Miranda.

Members:

Eduardo Miguel Vicente de Almeida Cardadeiro.
José Manuel Ferrari Careto.

2 - This appointment takes effect on the date of its adoption.
