Administrative Rule
Law no. 7/2006, of 3 March established the second amendment to Law no. 4/2001 of 23 February, which approved the Radio Law.
Article 44-A of Law no. 7/2006, of 3 March, provides that the music programming of radio broadcasting programme services must include Portuguese music with a minimum quota ranging from 25% to 40%.
Under Article 44-F of the mentioned law, it is incumbent upon the Government to establish by means of an administrative rule, for one-year periods, the dissemination quotas provided for in article 44-A thereof.
Whereas this is the first year of implementation of the referred dissemination quotas;
Whereas Law no. 7/2006, of 3 March, provides that programme services that at the date of entry into force of this law do not comply with the minimum 25% quota of dissemination of Portuguese music, may reach this quota, continuously and progressively, in the course of the three first semesters of operation of that law;
Whereas the regime provided for in the second amendment to the Radio Law shall be reassessed two years after this law has entered into force;
Considering the available indicators on matters concerning the consumption of Portuguese music;
Pursuant to article 44-F of Law no. 7/2006, of 3 March, and having heard the representative bodies of sectors involved:
The Government, through its Minister for Parliament Affairs, hereby orders the following:
1.º The music programming of radio broadcasting programme services must include Portuguese music with a minimum 25% quota.
2.º The provision of paragraph 1 above shall remain in force for a one-year period.
3.º This Administrative Rule shall take effect on 2 May 2006.
