Administrative Rule


Administrative Rule no. 767-A/93 from August 31, as revised in Administrative Rule no. 935/95 from July 24, foresaw in paragraph 11 that, concerning the evaluation of conformity of the devices conceived for radiocommunications broadcast with the basic electromagnetic compatibility requirements, the manufacturer, or its representative, should previously obtain a type CE certificate, issued by an entity notified for such purpose by the member states to the European Community Commission.

However, Decree-Law no. 119/96 from August 7, which transposed the Council Directive no. 93/97/EEC from October 29, concerning the equipment of the via satellite communications ground stations, rendered inapplicable such procedure, whether to the equipment encompassed in it, or to the telecommunications terminal equipment referred in Decree-Law no. 228/93 from June 22.

In conformity, it is important to modify the provisions of Administrative Rule no. 767-A/93 from August 31, revised in Administrative Rule no. 935/95 from July 24.

Thus:

The Government, through the Ministries for the Equipment, Planning and Administration of the Territory and Economy, under the terms of no. 3 and 4 of article 5 of Decree-Law no. 74/92 from April 29, as revised by Decree-Law no. 98/95 from May 17, hereby orders that nr. 11-A should be attached to the Administrative Rule no. 767-A/93 from August 31, as revised by Administrative Rule no. 935/95 from July 24, as follows:

«11-A - The conformity of the equipment encompassed by Decree-Law no. 228/93 from June 22 and Decree-Law no. 119/96 from August 7, with the basic requirements established in no. 1 is determined under the terms of no. 5 or no. 7.»
