At the request of Air Portugal (Dense Air), on 3 October 2023, ANACOM approved the draft decision to revoke the company’s right of use for frequencies in the 3.6 GHz band granted prior to the 5G auction.
In this draft decision, ANACOM determined:
- To partially grant Dense Air’s request by revoking the right of use for frequencies allocated to it in the 3.6 GHz band prior to the 5G auction, currently set out in ANACOM Title No 5/2021, with effect from the date of submission of the request (14 July 2023);
- To reject Dense Air’s request to give retroactive effect to the act of revocation of the right of use referred to in the previous point, with effect from 4 November 2020.
The draft decision is subject to the prior consultation of Dense Air, in accordance with the provisions of the Administrative Procedure Code, as well as the general consultation procedure, for a period of 30 working days. Interested parties may submit their comments until 17 November 2023, in writing and in Portuguese, preferably by e-mail to duf.densair@anacom.pt.
Once the consultation process is complete, contributions received will be made public, whereby interested parties should also send a redacted version of the elements considered confidential for publication on this website.
