2.7 Regulation and Supervision of the market for telecommunications infrastructures in buildings (ITED)


Context

The regulation concerning the regime for the installation of telecommunications infrastructures in buildings (ITED - infra-estruturas de telecomunicações em edifícios) and respective connections to public telecommunications networks, as well as the regime for the activity of certifying installations and evaluating equipment, material and infrastructure conformity derives from application of Decree-Law no. 59/2000 of 19 April.

This new framework of responsibilities vis-à-vis the elaboration of plans and installation of telecommunications infrastructures in buildings, also includes the certification of installation conformity (with the applicable legal and regulatory provisions and the respective technical plan) to be issued by the certifying entity or by the installer-certifier, of recognised competence and duly authorised for that purpose by ICP-ANACOM.

In the context of the ITED regime, ICP-ANACOM is responsible not only for overseeing compliance with provisions of the said measure, but also for the admission and registration of the several entities involved (designers, installers-certifiers and certifying entities), the disclosure of information on registered entities and certified installations, the evaluation of equipment and infrastructure conformity with applicable requirements and with the information contained in the respective certificates and declarations of conformity, as well as the approval of standards for implementing telecommunications infrastructures in buildings.

Also in this context, collaborative actions were begun with other entities, specifically the Institute for Innovation in Training (INOFOR - Instituto para a Inovação na Formação), the Institute for Employment and Professional Training (IEFP - Instituto de Emprego e Formação Profissional) and the Portuguese Quality Institute (IPQ ? Instituto Português da Qualidade), with the respective aim of designating training entities, setting up a technical staff training reference and, lastly, providing a context for ITED certifiers in the Portuguese Quality System.

Activity pursued in 2002

The procedure of registering technical designers and technical installers continued in 2002, with 1,216 new admissions (versus 1,387 in 2001).

Regarding certifying entities, 29 new ones were registered, for a total of 67 registered entities at the end of 2002. 

On the other hand, a total of 21.544 ITED conformity certificates were issued by the certifying entities and submitted to ICP-ANACOM. 

Beside this, 2002 also witnessed the start of activity overseeing the certifying entities according to the procedure approved at the end of 2001, with the aim of verifying compliance with the registration conditions, activity pursued and other obligations of those entities. In this context, 35 supervision actions were carried out.

ICP-ANACOM also approved (determination of 29 November 2002) the draft technical standard designated as ?ITED Manual?, which contains the technical instructions and prescriptions for telecommunications infrastructures in buildings ? following up the public consultation launched in August 2001. As a draft technical standard, the procedure of notifying the European Commission was begun as per the legal terms. This process continued into 2003; the previous specifications, prescriptions and RITA technical instructions consequently remain in force.
