Statement of Rectification

Amends Law No 16/2022, of 16 August, which approves the Electronic Communications Law, transposing Directives 98/84/EC, 2002/77/EC and (EU) 2018/1972, amending Laws No 41/2004, of 18 August, and 99/2009, of 4 September, as well as Decree-Laws No 151-A/2000, of 20 July, and 24/2014, of 14 February, and repealing Law No 5/2004, of 10 February, and Administrative Rule No 791/98, of 22 September.

For all due purposes, pursuant to paragraph 2 of article 115 of the Rules of Procedure of the Assembly of the Republic, it is hereby declared that Law No 16/2022, of 16 August, which approves the Electronic Communications Law, transposing Directives 98/84/EC, 2002/77/EC and (EU) 2018/1972, amending Laws No 41/2004, of 18 August, and 99/2009, of 4 September, as well as Decree-Laws No 151-A/2000, of 20 July, and 24/2014, of 14 February, and repealing Law No 5/2004, of 10 February, and Administrative Rule No 791/98, of 22 September, was published in the Official Gazette, Series I, No 157, of 16 August 2022, with the following inaccuracies, which are hereby corrected:

In paragraph 3 of article 10, for:

«3 - Administrative Rule No 1473-B/2008, of 17 December shall remain in force until repealed by the administrative rule referred to in articles 165 and 166 of the Electronic Communications Law approved in the annex hereto.»

read:

«3 - Administrative Rule No 1473-B/2008, of 17 December shall remain in force until repealed by the administrative rule referred to in articles 167 and 168 of the Electronic Communications Law approved in the annex hereto.»

In paragraph 5 of article 138 of the Electronic Communications Law, approved in annex, for:

«5 - The consumer may exercise the contract cessation rights provided for in article 137 and this article through the electronic platform created for this purpose, managed by Direção-Geral do Consumidor (DGC - the Directorate General for the Consumer).»

read:

«5 - The consumer may exercise the contract cessation rights provided for in article 136, the previous article and this article through the electronic platform created for this purpose, managed by Direção-Geral do Consumidor (DGC - the Directorate General for the Consumer).»
