ERG Common Positions
The European Regulators Group (ERG) published two common positions on the approach to remedies in the new regulatory framework for electronic communications and another one about bitstream access. These common positions were approved in the 8th ERG meeting held on 1 and 2 April.
The common position on the application of remedies presents a consistent and harmonized approach from the ERG and the European Commission services (Information Society GD and Competition GD) on the application of such remedies, with the characterization of the main competition problems, a ?remedy? catalogue, the principles that should orient the national regulatory authorities (NRAs) in the selection of the appropriate remedies and also a link between the main competition problems and the available remedies. The aim of this measure is to contribute to the increase of the previsibility level in the market regulation.
The common position about bitstream access defines this type of access, essential for the promotion of competition in the bandwidth wholesale market, including an approach to the resale and access point issues, identifying regulatory measures about the matter adopted by the NRAs in the countries that integrate the ERG.
Apart from these remedies, other subjects were also discussed in the 8th ERG meeting such as the international roaming service and the notifications related to the relevant markets within the scope of the new electronic communications regulatory framework. It was also decided to launch a public consultation about the Opinion proposal on the revision of the European Commission Recommendation regarding cost accounting analysis and accounting separation.
The Independent Regulators Group (IRG) also published new documents: the comparison of the mobile termination rates in the countries that integrate the IRG and the principles of implementation and best practice (PIBs) on the application of ?remedies? in the mobile voice call termination market.
