Determination
Under the powers conferred upon the Management Board of ICP - Autoridade Nacional de Comunicações (ICP-ANACOM) pursuant to paragraph 1 of article 15 of Regulation No 427/2009 of 29 October, as rectified by declaration No 2930/2009 of 27 November, which gave approval to the Regulation governing the auction for the allocation of rights of use of frequencies for Broadband Wireless Access (BWA);
Considering the decision of the appointed Committee to conduct the auction, as recorded in the respective minutes and notified to the Management Board of ICP-ANACOM;
Whereas, pursuant to point d) of paragraph 2 of article 5 of the Auction Regulation, the Committee determined to submit a proposal to the Management Board of ICP-ANACOM to formally admit the applications presented by the following entities to the auction process: BRAVESENSOR, Unipessoal, Lda., MUNICÍPIO DE SINTRA and ONITELECOM - Infocomunicações, S.A..
Whereas there are no grounds which give justification to a decision other than that proposed;
Under the terms of paragraph 1 and 3 of article 15 of Regulation No 427/2009 of 29 October, as rectified by Declaration No 2930/2009 of 27 November, the Management Board of ICP-ANACOM determines the following:
1 – to admit the applications to the auction for the allocation of rights of use of frequencies for Broadband Wireless Access (BWA) presented by the following entities:
a) BRAVESENSOR, Unipessoal, Lda;
b) MUNICÍPIO DE SINTRA;
c) ONITELECOM - Infocomunicações, S.A.
2 - to order that the present determination be notified to the admitted applicants and be published on the website of ICP-ANACOM.
