Amendments to the Essential Public Services Law come into force


The amendments to the Essential Public Services Law (Law no. 23/96, of 26 July), introduced by Law no. 12/2008, of 26 February, which establishes mechanisms to protect users of essential public services, have come into force.

These amendments have included the electronic communication services and postal services within the scope of the Essential Public Services Law, changing in a number of aspects the legal regime that applies to communication services.

Following the publication of the Electronic Communications Law (Law no. 5/2004, of 10 February) electronic communications services were removed from the scope of application of that statutory instrument, being now included therein once more, just as with postal services. For this reason, ANACOM has decided to publish an impact analysis of these changes on the relevant legal regime.
