ANACOM has approved a draft decision in the scope of the administrative settlement of a dispute between SONAECOM and PT Comunicações (PTC), regarding compensation payments for non-compliance in 2006 with levels of quality of service, as regards deadlines to restore service (fault repair time) established in the reference unbundling offer (RUO) and in the reference conduit access offer (RCAO).
This determination generally provides as follows:
- Not to grant the application to determine the obligation on to pay SONAECOM an amount for compensation for non-compliance in 2006 with deadlines to restore service (fault repair time) established in the RUO and RCAO, as well as the request to pay payable and future default interest on the amount under consideration; and
- To dismiss the measures of evidence applied for by SONAECOM on 15 April 2008, which were deemed not to be useful nor necessary to the determination of the facts at issue.
Pursuant to the Code of Administrative Procedure, a prior hearing of interested parties was launched, SONAECOM and PTC having been given 10 working days to assess the matter in writing.
