Amendment to Essential Public Services Law


Law no. 12/2008, of 26 February, was published yesterday, introducing for the first time an amendment to Law no. 23/96, of 26 July - Essential Public Services Law (EPS Law), which establishes mechanisms to protect users of essential public services.

As far as the communications sector is concerned, this amendment is important for the inclusion of electronic communication services and postal services within the scope of that statutory instrument. It should be stressed that in 2004, following the publication of the Electronic Communications Law (Law no. 5/2004, of 10 February), the fixed telephone service had ceased to be covered by the EPS Law.

Amendments having been approved, this service thus falls again within the scope of the EPS Law, which is broadened to cover also other electronic communication services, such as mobile telephone service and Internet access service, among others.

These amendments take effect ninety days after being published, that is, on 27 May 2008.
