EC public consultation on R&TTE Directive


The European Commission (EC) has opened a public consultation on the R&TTE Directive (Directive 1999/5/EC of the European Parliament and the Council of 9 March 1999) on radio and telecommunications terminal equipment and the mutual recognition of its conformity.

Information will be compiled with an online questionnaire and will be used to draw up a Second Progress Report on the operation of the R&TTE Directive, in line with the review stipulated by Article 17 of the Directive itself.

In its introduction to the consultation the EC emphasises that the review of the operation of the R&TTE Directive should be carried out in conjunction with other legislation, especially radio spectrum policy and the regulatory framework of electronic communications; this framework has been under review since 2006 and proposals to amend it should be submitted to the Parliament and to the Council at the end of 2007.

The Commission points to examples of this interaction: the effect of some R&TTED provisions on putting radio equipment into service is substantially dependent on EU legislation covering the right to use spectrum. Similarly, the legal regime of “telecommunication terminal equipment” is currently split between R&TTED and the Universal Service Directive.

This consultation, which closes on 30 September 2007, aims to gather information from the various parties interested in the Directive’s application, including equipment manufacturers, importers, and providers of electronic communication services.
