Contract prevention mechanisms - shared


ANACOM has given approval, by determination of 8 March 2007, to the opinion on the functioning conditions of the shared database that is to allow operators to identify subscribers who have failed to meet their payment obligations with respect to contracts which they have entered into. This database is provided for by article 46 of the Law of Electronic Communications.

The opinion, which was issued following a joint presentation by the three mobile operators of the (shared) database project, covers the conditions that the functioning of the database has to comply with and guarantee. These encompass the relationship between the operators themselves, the relationship between the operators and the body managing the shared database and the relationship between the operators and their customers.

The key conclusion of the opinion is that the costs for accessing and using the database by the beneficiary companies / operators should be adjusted in such a way that they do not present an obstacle to its use by new electronic communication operators.
